    My letter to mbna did request standing order information, but you are right, the rma letter does not confirm if they now own the debt if it has been sold on it is only suggesting that mbna has asked rma to contact me.

    I will now do my letter enclosing copy of my letter to mbna and put in the advice given many thanks

    Personally, I would want to know why MBNA has 'passed on' the debt to RMA, whilst you were trying to negociate a payment plan with them. I am sure that the OFT would 'frown' on such behaviour, especially since you do not deny the debt, nor were you trying to avoid the original creditor.
    I think it may be advisable to give National Debtline a call - 0808 808 4000. they may advise you to request a copy of the cca and deeds of assignment, proving that RMA are, indeed, authorised to 'collect' this debt.

    Well National Debtiline advised to write to RMA advising them of my last payment to mbna and of when my next payment will be, and for them to send me standing order details if they now own the debt. Also to reiterate any communication by letter only and NO PERSONAL CONTACT neither, the debtiline advisor stated this so this will stop any home visits too - fantastic!

    Also to write to MBNA with a complaint advising them that i want confirmation from them of the requested information in my prior letter and to confirm if this debt has been passed on and been sold to RMA and why was i not informed this was going to happen. like you said as well, i had tried to explain my situation and yet as a valued customer been ignored by mbna.

    Also to write a seperate letter asking for cca with £1.00 postal order to mbna

    all letters via recorded delivery

    Nationaldebtline advised that i was doing everything correctly and i should not worry about any court action yet, and to contact them if i do get court papers..

    So appear now calmer, thanks to them and you on here.

  • I cannot believe that I have had an MBNA credit card for a few years and have never missed a payment until last month when I got made redundant; all of a sudden I have RMA on my back about it - over one lousy missed payment. The thing is; I then paid some money off the balance, yet they are still chasing me! What is the matter with these people?! Just one poilte phone call to remind me that I'd missed a payment would have done the trick; but no; I'm getting letters and texts to call them! These people make millions as a debt collection agency; yet they expect me to fund their phone call! Ironic isn't it?!

    well this is what you can now expect from mbna unfortunately, ive finally managed to get them onto a plan, but only after much hassle off rma, who are just people mbna employ to get hold of you to pay up, its not been sold to them, perhaps inhouse people or contract as im now dealing directly with mbna and not rma, they never responded to my cca request way back in may of this year and yet mbna say they have sent me details,

    im now tonight in the process of going directly to mbna with my formal letters re requesting the cca - as i now understand new legislation has come into force since may 08 and they do have to respond it is law, also am now sending a full DATA request with my 10.00 for all my 3 mbna accounts, now im much together with things im starting my own battle lol

    i do hope you hang in there, but if you find you can get yourself sorted they will possibly stop, its just a nightmare, and i was upfront with them from march when i told them of my difficulties yet i still had to deal with them until finally july this year to get myself accepted on the plans id proposed.

    i hope you can resolve your problems soon any concerns pls shout ciao for now maz

  • I too have fallen victim to the charms of this delightful company. My MBNA account is now with them - despite informing both MBNA and RMA that an IVA was accepted in June. Still getting calls almost daily from them (i ignore most) and letters. They do not seem to Understand plain English, or they are really programmed automatons! I have read some of the threads and it is comforting to know i am not alone. I am going to take the advise i have read and also contact OFT.
  • Hi just thought I'd post my support for this thread as I too have been contacted daily by RMA, every time asking me why I havent paid the minimum amount (about 80 quid) even though I have sent my budget sheet to both MBNA and RMA and offered them a £1.00 a month token payment as I'm in receipt of Incap Ben. I've also received as many letters from them as calls.They leave me answerphone messages, sometimes 3 or 4 per day asking me to contact them 'urgently'... surely this should be counted as harrassment?? I get 60 quid a week and they expect me to pay them hundreds whilst I have other creditors as well... idiots. Why don't they wake up and realise that you can't get blood out of a stone? Can't wait til they take me to court seen as though I can't even afford my priority debts can't see the judge forcing me to pay even the £1.00 a month.

    It's got to the point where I am going to answer the phone to them and be nasty but don't see that getting me anywhere as they would probably note me down as being uncooperative or something. (Don't worry rant over til I get the next call!!)

    hiya all

    just wanted to offer my support ref mbna and rma, they are pure muppets, ive now got my business head on, im also on incap benefit and hope to get back to work soon though,

    from my earlier post on the 12.8.08 above on this thread ive now managed to get the letters sent, ive asked to be sent a true copy of each of my credit card agreeements , they have to forward within 12 day s ITS LAW.

    if they dont they are in default and you can report them to trading standards

    there is more info on the site but basically until they provide the full info on your request they cannot chase you for money or you are really in no position to even pay, however, i would suggest you continue paying what your proposals are - im still paying my monthly amounts as they have put me on a plan and no interest or charges for 12 months or unitil my circumstances change. Should i go to court at least i can show the judge been paying what i proposed however, ive also asked for the cca which is my perogative by law.

    so whether the phone calls stop or not, i would also put in a letter to stop calls and only contact you by phone, ive had resistance but in the end they have stopped and deleted my inaccurate tel no at work as im not there to be contacted.

    my anger now has been replaced by good business practice on my part, send all correspondence in writing by royal mail recorded 1st or 2nd class signed for. keep all copies of my letters and their letters including the envelopes, something to do with the bar codes shows accurate date of posting, they are known to backdate dates on letters so they are in legal time frames, no kidding!!!!

    Never sign the letters, i use a font from word and "sign my name " and making it totally different to my actual signature. They are known to cut and paste your signature onto documents, really!!!!!

    so again all im saying is do not be afraid, find out all you can and ask questions we will all help you
