    Yes, its something to think about. Im not sure if you are tied into B & E for any length of time though. Would certainly be nice having the debt paid off quicker too.

    These charities are only a phone call away wormy, and you don't have to take their advice if you don't want to. You'll find you won't get even near a NB either. I realise that it might seem to be a big step. I too have been on the receiving end of calls etc and I often wish it would simply all go away. But I think I've finally cottoned on that it doesn't and sometimes you have to be pro-active.

    I assume you have a written agreement with B+E, it should detail any tie-ins on that.

    I was with B & E for no more than a year from 2000 to 2001.
    When I became fed up with their rubbish service, I wrote them a letter requesting immediate termination of our agreement & this was carried out with no problem except for them returning somebody else's file to me with the same name who lived in Scotland. Very professional!
    They are an ex DMC & I was charged 17.5% of my monthly payment of £350 (£61.25).
    By my calculations, I've saved myself £5328.75 up to this April that I would have paid them in fees & my now self administered DMP still has another 8 months to go.
    You shouldn't experience too many problems if you approach your creditors in the right way, because you should be able to offer them all a small pro-rata increase in your monthly payments due to freeing up the fee that you've been paying to B & E.
    Your creditors receiving more money usually seems to have a very persuasive influence!
    Also, of course, the CCCS will be able to offer this on your behalf should you wish to use their services.

    Whatever you do, DO NOT talk to RMA over the phone. They talk to you as though you are a criminal and try to intimidate you into paying more than you can. Let them know you will only deal with them via post. They will give you the speech about it being a 'telephone only' company. Ignore it

    Going back 5 years ago my husband was dealing with them, they had a right go about the amount we were paying back (50pm) and went through all our income and outgoings, when they found out we had a car the guy told us we had no right to spend money on a car, tax, insurance, MOT and petrol when we had got ourselves in a mess and had to pay it off :eek: He told us we were to put it up for sale immediately and repay the money to them :rotfl: Bless them, they dont have a clue!

    Stick to your guns and continue paying whatever you are at the moment. Don't waste any more time or money talking to them.

    got their letter today starting as "MBNA have instructed us to contact you urgently to secure payment of the overdue amount to bring your account back up to date"

    Please contact us immediately etc,,,, Failure to do so may result in adverse information being reported to the Credit Reference Agencies.

    As a valued customer, MBNA are confident that you will repay the arrears shown.

    You must call us to confirm payment has been made to prevent any further action from being made.

    My question is as i have already written to mbna on 27.03.08 via recorded delivery, enclosing budget sheet, explained after liasing with National Debtline and used one of their template letters, ref pro rata payments.

    I asked them to agree to reduced montly payment of 18.00 etc,

    I also informed them "all communication is strictly made in writing to me and to please remover contact numbers from their records under the Data Protection Act to comunicate with me via letter only"

    I had already made a first payment of 18.00 and the next is due from the 23.04.08.

    They have now also send me a text asking me to contact them on above telephone number.

    1. Should I write to them enclosing copy of my letter to mbna and also the budget sheet and again ask them to only communicate with me via writing and that i will only respond by letter.

    2. Ensure that they do not contact me by telephone or mobile and to remove my contact details from their records too.

    Have had a look at other threads so this is what i think i should do, but ask you kind people to give any other advice please much appreciated.

  • Write to them and enclose a copy of your letter etc to MBNA, and say once again that you will only deal with them in writing. However, if your debt has been passed on to RMA, then you need to be paying them, not MBNA.

    DO NOT set up a direct debit or give them your card details. Set up a standing order instead (let them give you their account numbers). That way you control when, and how much, money is sent to RMA.

    Once you are paying regularly, put the letters aside. They will keep on sending them out regardless of what you say.
  • Just wanted to add that you must try your best to stick to whatever you say you can pay.
