Ebay / Postoffice Question-please Help

I sold my IPOD on ebay last week.

Rushed to the postoffice with 5 mins to spare and had few parcels to send.

Because it was the buyers sons birthday - he wanted it sending ASAP. I sent it the quickest way. Which is 1st class parcel.

The guy has emailed me a few times saying he hasnt received it, sits been over 10 days now.

Not sure what to do, I have proof of postage and have called the RM who told me and item is lost untill 15 days, then I have to fill out a p58 form.

Also I know I should ahve sent it recorded just forgot, but cant help thinking maybe the guy ahs got it and its just saying he hasnt...maybe me thinking the worst.

Do I give the guy his money back or wait to see what the post office say?

Absolutely wait to see what the PO has to say! Send the buyer a scan of your proof of posting, and tell them that you are pursuing it and will refund as soon as the PO refunds you.

There is absolutely no reason for you to be out of pocket because of their failure, and yes, it could be a 'try on' by the purchaser.

Special delivery is the only guaranteed fast method. If the ipod sold for more than £34, it won't be insured for the full amount.

Has the buyer checked at the delivery office?
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

If the buyer opens up an Item Not Received dispute with paypal, the seller will have no choice but to refund, and hope that RM pay out the full £34.

If after 15 days (working days as well if I recall), ask the buyer to confirm by email that the item has not arrived. This email, along with copies of the paypal transaction and ebay listing, will suffice as backup documentation for your claim, but bear in mind that these can take a month or two to come good in my experience. It's doubtful if the buyer will want to wait this long for their refund.

  • I can't believe you would send a iPod via 1st class post. As somebody already suggested, you should of sent it via Special Delivery. For a few quid extra it would give you peace of mind. Even if it did get there in one piece, what's to stop the person saying they didn't receive it when they did.

alert your buyer to the fact you have opened a claim with royal mail and have forwarded thier address to them and that royal mail will probably contact them to assist in the investigation.
i have done this in the past and the item just so happened to appear the next day!

    Hi

I have an ebay store and i would recommend that you provide the buyer with the proof of delivery receipt.

If he wanted it urgently he could have paid you the extra for special delivery since it has its compensation.

I know its true that you should have sent it recorded, but its not your fault its been 'lost' !! But a lot of ebay sellers do specify that if an item isn't received then they will provide the proof of postage to the buyer.

Just my opinion, but i hope you sort it out anyway! xxx

It's down to the sender to make a claim not the person it's sent to. Also as stated recorded delivery would only cover up to £34 or £36 so if it sold for me the sender would lose out. If it sold for more it should have gone by special delivery. I also don't think recorded is worth the extra 70p as they don't always get signed for.

Just do as suggested you do as goldspanners is saying as this might put them off if they are fibbing.
Thanks for any help and advice given

it doesnt matter to the buyer how you send it,only that they recieve it
recorded covers £36 like 1st class and isnt tracked
    sd protects the seller
offering to send proof of posting is poor seller practice and means you lose the paypal chargeback and your chance to claim via rm
