I am giving my ll notice in a couple of weeks he says he keeps my rent book??

I was going to keep it as proof that he doesn't declare the £122 pw he gets from us an lots of other stuff so i need to keep it for proof for the HMRC he says that it is still his property.

yes it is in my possesion, it says in book and on my ten agreement that it must NOT be photocopied, so on that note would i get into trouble if i did photocopy it to give it to HMRC?0

Mheh, I'd photocopy it. What's the LL going to do? Sue you? You're moving out anyway. Is the LL's name on the tenancy agreement, along with the rent? That would help too.

I didnt give a deposit he let us move in with no month in advance and we pay a couple of £ a week toward deposit (been here for 18 mths) his name is on everything and signiture.0

Photocopy it. Just do it. The reason it says 'do not copy' is probably the reason you need to copy it for so: either you agree to take no copy and no action or you need the evidence of the photocopy.0

Just curious .... how do you know it's proof that he doesn't declare it?
If he were looking to evade tax, it's unlikely he'd keep "proof" that he collected rent. He'd more likely collect rent in cash and have no proof at all.Warning ..... I'm a peri-menopausal axe-wielding maniac0 -
he does get it in cash and i know he doesnt declare it they live upstairs and there are lots of other bits and pieces i know of, and thats prob why he is asking for my book back when we move0

Photocopy it. Move away and hand it over to HMRC.
Any restriction on the book re photocopying implied or otherwise ain't worth sh!te.anger, denial, acceptance0 -
Why not just send HMRC an anonymous(?) tip off now. THey will get all the proof they need if he tries to rent an undercover inspector the flat.......
you never know they may have a camera crew with them for one of these undercover govt department tv shows (trading standards I know I've seen) and that would make good viewing.... Even if you did copy it, what can he do? Does he look after the property properly? Gas safety certs, etc etc.... maybe let someone know about that also....even more dangerous to society if he lets things like that slip...0
