Demanding money that you don't owe is called fraud. I suggest you report them to the police. Make an accusation against the named individual responsible for the fraud. The CSA haven't acted fraudulently - they have not received the money and legally it is up to the NRP to ensure that the CSA receives it. It is the post office who is at fault here - not the CSA.0

Just a quick question, and I'd prefer to opt out of people giving a 'Jeremy Kyle' approach to replying please!!
My ex wants me to give her money monthly and has used the CSA website to calculate how much it will cost but I'm anxious about giving money that may be used against me in the future if I can't prove I gave it to her. I said to her I would prefer to go down the CSA root as I have black and white proof that I am making payments on a regular basis but she says this will mean she loses out.
Any suggestions would help or anyone in a similar situation, I mean could she turn around in four years and say I paid her nothing?

I'll answer this one-for years my ex paid me direct. Like your ex we did the calculations ourselves and he paid me. Everything was well until he got involved with a partner who was super controlling and wanted more money and attention for her own children and he stopped paying. I then filed direct with the CSA and they recalculated -however managed to screw up to the point that a year later they hadn't collected a penny despite BOTH of us co-operating with them. By then the partner was off the scene and both of us were sick of the CSA and we told them we were switching to direct payment. During that year if my ex paid me by cash I would write him a receipt, if it went in through the bank he kept the paying in slips-both were acceptable to the CSA.
My advice to you-unless you have the patience of a saint and a LOT of time on your hands to waste speaking to nurerous people at the CSA who promise to do stuff and then do diddly squat is accept her offer of direct payment and set up a monthly standing order. She'll get the money and know exactly when to expect it each month-and you'll have your proof in the form of bank statements.
If she's working it doesn't affect tax credit however it is paid-if she isn't then she'll need to apply via the CSA in the absence of a CSA order anyway for council tax benefit for sure-and I imagine also income support.I Would Rather Climb A Mountain Than Crawl Into A Hole

I don't understand how she could lose out unless she was on benefits and any money that you paid would be taken off her Income Support pound for pound.
If she is on IS then she will have no choice but to involve the CSA. She will be told that if she refuses to give the name of the father then her benefit will be cut.
I agree with Duchy. If she is working and there is no need to get the CSA involved then don't. Pay the agreed sum by Standing Order into her account clearly stating it is maintenance payments and keep your bank statements - just in case!!

So both parties lose out, the mother of the child, and the father of the child who cant afford to pay money that has already been paid.
It is a crap system IMO and it is ok, we will just stop paying the mortgage to pay them what we have already paid, go bankrupt and live on the streets.
And thanks for your understanding donedoingdebt, its rare to get that when its the father, thats why there are so many suicides and sad stories in this country.0 -
