Help ! Cant get Deposit back !

Can anyone offer advice.

I went to DFS told them i needed either corner unit or 2 sofas to fit 2 walls that meet. I gave the guy measurements of the walls, he measure sofas for me and said they would fit.
I paid deposit £200 and waited 6wks. When they arrived the guys from the van brought the 2 seater in but looked at the other wall and said the other 3 seater is not going to fit as the sofas will overlap !!

When i spoke to the store manager on the phone he said the sofas were now 2nd hand and if i didnt accept them both basically that if they sold one to another customer it would be as 2nd hand and i would have to pay the difference.

OR if i said replace a sofa with arm chair i would still be charged the cost of a sofa for an arm chair !

This was not on finance it was cash purchase, he also told me it would take a few days to try re-allocate the rejected items and he couldnt tell me at what loss to me.

So we decided not to accpet them as we were worried of the cost of the loss.

At the time of ordering I was never told i'd lose my deposit and i cannot see that on the order form
nor can i see that rejected goods are seen as 2nd hand and we have to still part pay for them.

I argued this is poor customer Service to not advise me of thses issues at the time of my order. The manager disagreed.

At the bottom of the order it states the goods are made to YOUR SPECIFCATION, therefore the order is legally binding.

But they are not made to my specification or they would have fit according to the measurements we gave the sales guy.

We didn't go in blind to buy a sofa without measurements.

I am getting no where with regard my depsoit refund.

Any help is appricated.

  • Try calling your local Citizens Advice Bureau for legal advice. Were your dimensions recorded anywhere? If they were you have a good case for deposit return, if not it could be difficult.

    What have you got in writing? Have you a written record of the measurements you gave DFS and a written record of the size of the sofas?
    If they were made to order the spec should exist in writing somewhere, if they were standard stock the measurements should be on the DFS website.

  • They have not recorded the measurements anywhere
    and the paper work says

    'the goods will be made for you and to your specifications'

    but they are clearly not, as no measurements have been recorded
    as the sofas didnt fit.

    My bank say if deposit was made on a credit they could have helped
    but as it was a debit card they can't.

    My main gripe is that i was never told the deposit was non refundable
    nor was i told what happens if items not suitable and its not on the paper work.

    dfs made and delivered a sofa that you ordered, while i think their stuff is not great and i am no fan of them, what do you expect of them, they did not measure your walls, you did, and if you measured the walls then you should have measured the sofas too.
    how, without any recorded measurements, can you be sure you supplied the correct measurements. are you expecting them to take back the sofas for a full refund? even though the fault is yours at least by omission?

    my sentiments exactly !

    we measures the walls correctly and the sales man measured the sofa's

    all in all a disaster ! to the loss off £200 !

    we havent given up yet ................ watch this space !

    When you went in with your measurements did the salesman advise you on a particular style of sofa that met those sizes?

    The measurements wouldnt be on the order if for example he sold you a sofa from a range in the showroom. The order would simply be for that particular style name. But sizes are standard to that style. If so then made to your requirements means it has been dyed the colour you chose.

    I too think you should get advice from CAB, seems like your getting a very one sided deal and they dont seem to be meeting you anywhere in the middle to resolve the issue.

    When you say the sales person measured the sofas, were these sofas on display in the showroom? Or were you shown some similar and then told that they would recreate these to your measurements? If the latter, I would have expected them to have to draw up plans for the sofas for sizing etc which you would have to have seen before paying as presumably the cost would depend on the size of the made to measure sofas?
