Bad Quality from a s Seller

Hi, I have had a very bad experience after buying an £815 garden shed and after a long time of exhausted promises from the company that they will guarantee to exchange it for a brand new one nothing ever materialised.

I have taken them to the small claims court to get a ccj against the individual who owns the comapny as he is a sole trader and I managed to find his home address. He has just contested the claim and I need to get an independant report done on the quality of the shed does anyone know where I can get this done at a very reasonable cost. This hope fully will help my case when it goes in front of the Judge.

    If they've already admitted in writing that they will replace it that's all you should really need but any local chippy should be able to help. Just remember to claim for the cost of the report too.

    Yes it is ! The shed is in a hell of a mes only 2 months after we bought it in Sept 06 we have been battling with them since that time qas we have had many problems and the shed has gone all black and all the timbers have warped very badly,

    I just received a defence from the Guy who i am trying to claim against he is saying that he was only a casusal employee & that he is now out of work even though I have correspondance after the date he says that the company ceased trading.They are advertising now on Ebay for these sheds and all of the contact details are the same except now thay have changed the company name.

    Do emails count as proof that they were still trading ? Are emails as good as letters?

    A casual employee is named as owner of the company?..Don't they have to let companies house know about previous names? Or was he not on Companies house website? Can you name the Company?

    Not on the companies house website he was acting as a sole trader when we purchased the shed last year they were called stb sales but a few weeks after whenn they answered the phone they called themselves Timbabuild now they call themselves u.k sheds. Everytime we spoke to someone they said that Paul ( This is the guy named in my court claim) was the boss and he makes all the decisions. I sent this paul an email on the 01/02/2008 at the email address still showing stb sales and I got a reply saying that vthey would contact us with regards to a replacement. The email was from A Lisa Higgs who is his wife and even she mentions she will speak to paul :-)

    This guy sounds a right shifty one,

    They were advertising on Ebay i did not buy through the Ebay site as it listed there tel number & Email for contact to discuss anything about the Sheds. As I needed a particular design where I needed the door i emailed them and they Then dealt with me via the same and the order was placed by tel ,

    If they were using a business name on Ebay,then could you ask Ebay to confirm the name of the account holder. Or contact advertising standards authority first and confirm how you could get this info.,if he is disputing he is the owner.I think you need to confirm who owned the company. Go into council offices and look at electoral role to see who is registered at their address other than the wife.Have you discussed it with Inland Revenue? Also put a question on the small business board /Ebay board here?
