Options
Hi,

Had my 2nd hand car 5mths ago (Landrover freelander R REG)

Came with 6 months warranty
Car broke down 2 weeks ago...Diagnosed as rare diff

Warranty company said they would pay...because still under warranty

Garage found PROP SHAFT???? Has some kind of tape wrapped around it, which I didn't see when i got the car (basic knowledge) Also FOUND A HOLE IN THE AXEL!!

Warranty company inspected car and DISMISSED MY CLAIM   because this is caused by wear n tear, not mechanical defect!!!!

Please can anyone advise...does anyone have car knowledge AS THE BILL IS HUGE!!!!

I AM DESPERATE FOR HELP FROM YOU CAR EXPERTS AND PROS ;)

Thanks

unfortunatly if the awarrenty companys only covers mechanical defect then theres little o it.
what you will need to do is get another garage to insect it and find its mechanical defect which is unlikely.am i reading right that something wrapped itself round the prop?

Hi Sweet C. as posted on the other thread, please tell me your approximate location in the UK (a county will do) so that I can recommend a LR specialist in your area who could give you advice on the most economical repair if your warranty claim is dismissed.

'scuse me for jumping in, I've had an idea which MIGHT be helpful...

Rather than chase up the warranty claim, have you considered claiming for the repair from the dealer? (I'm guessing it came from a dealer as you said it has 6 months warranty).

I assume the vehicle came with an MOT and wonder, could you have an AA or RAC or WHY vehicle inspection and report done now to see if it is road worthy (the hole in the axle alarms me as well!) and whether the dealer has sold you a pup, that they should get fixed to make good. The only thing is that you might have to prove that the tape and hole have been there since you bought it...

I'm not sure how you stand legally with the Sales of Goods Act but it could be worth investigating.(don't get your hopes up though!). http://www.consumerdirect.gov.uk/before_you_buy/thinking_about/cars/dealer#named2

    Good luck

the issue is if there was something wrapped around the prop that caused the damage.
mot's are only as good as the day its done and given how long the op's had the car it wouldnt be viable i dont think
remeber this is an r reg so its not a new car

fit for purpose wouldnt cover damage though.
thats like crashing your car then asking for it to be fixed as its not fit for purpose

I would like to thank pokem02 & custardy for their comments.

I never had the car checked out when I bought it and this was the 1st problem that has happened since Ive been driving it. I bought it in good faith!!!

I assumed that this tape wrapped around the prop was definetly done before I got the car. Also a MOT was done a month before I bought the car - who can say that you can trust those people.

But I have decided to sue the dealership and claim back the money I had to pay to get my car back. Cos the warranty people dont want to know and I am in the process of writting a complaint letter to them.

    Thanks again for your help
