I believe it's an urban myth that civil notices aren't legally enforceable. If the sign is prominently displayed (and it was), is observed by the car park users (and it was) then any fine which is shown on the sign can be issued (and it was). With that taken into account, i believe the car park operator are perfectly entitled to chase any money they are entitled to using whatever means they deem necessary while staying within the law.
Have you changed your opinion in light of the Excel case, confirming that penalties are not allowed under contract law?0 -
I appreciate all the advice on here by the way, I personally didn't ignore the advice at all. Big thanks to all you guys for taking time out of your lives to help out people.
In this case I gave into peer pressure no less, but I've not chosen to ignore all the comments on here, I shall learn from them. Hopefully i'll never be in this situation again but I shall be slipping the ticket in the bin before I get home next time its a private company issued parking invoice.0 -

I don't know what the "Excel" case is but having read through the thread and some of the links then it does appear that i was of the wrong opinion. Thankfully I've never paid a parking charge issued by a private company so i haven't lost out.
If i am ever penalised then i will be in a position to fight my corner!

I just wanted to check if the advice for ignoring the tickets is correct. I was parked in Sainsbury's and we were shopping for 20mins. We were doing sainsbury's shopping and have receipts to prove it. He even wrote 20mins duration on the ticket with start and end times!! The car park sign says that parking is free for 2 hours then a ticket must be purchased. We found a ticket from Euro Car Parks on our screen.
The guy said we should send it to their address with a copy of the shopping receipt and then they should cancel it.
Firstly, he is illegally issuing out tickets that do not comply with the sainsburys sign. Is this worth taking this further with some governing body that controls ticket companies?
It was not just us lots of people were walking round with the slips really mad. I think they just did a blanket ticket charge on the whole car park for all shoppers. Maybe the ticket issuer didnt understand the sign? Please advise.0 -
In our local sainsburys we have to get a ticket even if we are only parking for the free 20 or 30 minutes - its free, you just press the green button and display the ticket as normal
