I have just found this website today. Thanx God as I thought I am the only person affected by this bush company.
The same happened to me. They called me pretending to be O2. They pulled the account details from me and on that basis they say I have a contract with them.
After 3 month of struggle, Telecom Debt Collection Agency chasing me for outstanding bills with 3, I finally agreed with FMS to send the handset back and they promised to cancel the contract. I did it. I sent the phone to 9 Axis Court SA7 0AJ in Swansea, however Telecom Debt Agency called me yesterday that '3' bills are still not sorted out. So I rang FMS again and what I have heard? "we asked you to send the handset back becasue you have outstanding bills with 3 but we did not cancel your contract" Having heard this I called 3 and they arragned call conference with FMS (Jason Cumnor from FMS end) and they passed the case to another department, promised the will call me back, so I am awating reply now.
This is a pure farce - this company needs to be clamped down.>
Anyone can advise? Is Ofcam aware of them?

FMS has just offered me contract cancelation if I pay the outstanding balance with 3 - shocking - they want me to pay for sth I have never used.
Can anyone provide the contact details, so we can exchange the experiences? Maybe if we join the forces together we will be able to win the case.
I reported it to consumer direct and they only advised me to sue the company if they don't reply to any of my attempts to cancel the contract.0 -
Hi All,
I like the others have been roped into this. Got a call etc etc. I took a phone from them because it had free skype calls.
I got the phone the next day, and switched it on, but couldnt get skype working. I called 3 and FMS to see why it wouldnt work. Turns out, the phone isnt even compatible with skype. So I called them and they gave me an address to send the phone back.
Not heard anything for a month or so, then 3 send a bill. I call 3, and the phone hasnt been cancelled (nor has it been returned to me, although FMS say they have sent it back to me).
I now have the debt collectors onto me because I wont pay (Why should I? No phone, and it was mis sold to me)
I now have contacted trading standards who can hopefully clear my name!0 -
same thing happened 2 me missold contract faulty phone. freemobiles4u will not cancel the contract - when they contacted me they stated that as i was still in contract with 02, they would not bill me for 6 weeks - received a bill from 3 within a week - handset faulty after 5 days rang to query and would replace faulty handset and told meto ring 3..rang 3 who sent me back to fm4u. went 2 ofcom who advised me 2 write 2 both companies ofcom provided me with a ref number. received a call deom daniel rees claiming to be general manager he has promised to send me a cheque to cover bill from 3, still won't replace the faulty handset. still have not recieved promised cheque. I am now going back to Ofcom to persue further - have also contacted consumer direct who have logged my case.
I have been conned like the rest of you - we should all stick together with this - everyone should contact ofcom and consumer direct and we will nail them!0 -

The are also aware of FMS and the more complaints the get the quicker they will be able to deal with the whole isssue.
I called FMS on 02/08/2008 to receive the contract cancellation code and the said I will be given this tomorrow - 04/08/2008
I will try to call them again tomorrow and will keep you guys updated but it looks like that the whole situation is going to end up in court as debt collectors are andamant to get the money..0 -
my daughter had this with a company about a year ago ,sent ,made phone calls,e-mails,letters specail deliver ect no answer to any ,all with in two days of getting the phone, we found out because she rang orange and to ask if she could change the billling date and she was told she had two contracts running (oh my god)
orange tryed to get to speak to these poeple put no joy in the end i rang comsumer direct and asked them what to do, the woman i spoke to was very help full even through she make me feel like a kid ,there was none of you can do this ,it was you will do this today now ,yes
this was done all in seven day and sent the phone and sim card back to the poeple that sent it ,and then started on orange two week later orange cancelled the contracted has they could not get hold of the poeple that sold the contract.
since then any one that rings up about a upgrade or any thing like that get told in no certain terms to go away ,and a few i play with which they do not like (costs them money to ring a mobile and they lose a sale)
i had some poeple ring me about my upgrade has it was time and they all said they was t-mobile (i with TM)and they did not like been ask what extension they was on so i could ring them back on 150 and one even tryed to beat my deal i have with TM put they did not come close because i am on the advanage plan 1/2 price line rental for life and i only pay £20 a month for the new flex 35 inc wnwthere or their,one day i might us the right one ,until then tuff0 -

guys, do NOT be a fool like me and get persuaded into this joke of a company. We are given 7 days to change your mind which you are entitled to do! This is what i did, plus freephones told me a few lies i.e. current network would not charge cancellation, all i had to do was send a cancellation letter and they would reply with a code to enable to cancellation... complete RUBBISH. I called to ask for the return address for the phone and after 40mins of getting nowhere i had to put down the phone because i was left in tears, angry and shaking. The rep refused to give me the details but just went on about how great they were and how stupid i was not to go with them. Bullying tactics used and disgusting outrageous customer service. i got the address in the end after getting through to the manager...eventually. I am reporting them to trading standards, offcom watchdog etc etc. DO NOT USE0
