Just a quick question I have sent a cca request to gm card they have admitted they do not have it what is my next step I want to offer full and final settlement but should I put the account in dispute as well or just go for full and final settlement?
also barclaycard have completly ignored my letter what do I do next the letter was sent about 2 months ago?Make £5 a day in May total so far £20 -
I would suggest sending the F&F letter, but in this state why you believe the debt to be unenforcable. Let them see that you are aware of your rights and that you know that you do not need to pay anything until an enforcable CCA is produced.
This should make them aware that if they do not take your offer they may end up with nothing. Possibly also worth enclosing a copy of the letter that states that they don't have a CCA for the account.

Hi all,
Further to my posts yesterday ( 4035 + 4040 ).
I phoned the bank for an update and I was told by a pretty abrupt young man that the banks position was unchanged and I would receive a letter over the next few day's outlining the banks response in detail.
I said I was unhappy with this and was going to take it to the Financial Ombusman..... The little t**t just laughed at me and when I challenged him he hung up!
If the bank thought I was angry before I'm blazing now, I am know in the process of dealing with the Ombusman, I'll let you all know how I get on.

Good luck WW - don't forget to quote the relevent legislation to back up your claim.
Also it would be worth getting the DSS response in writing so you can send it as proof to the Ombudsman.

Hi all,
Update on my 4407 posting, the bank phoned back this afternoon offering an apology for my previous experience.
They tried to explain why they were giving me nothing back ,but it was just waffle like it had been refered to the Managers thats why it had taken so long to reply.
They offered to refer it to their internal policy department to make sure they got the decision right and they had followed procedure and then if I am still unhappy I can go to the Financial Ombusman.
Should I just go to the Ombusman just now and forget their internal inquiry?

Looking for some advice, I CCA'ed La Redoute (Redcats) and after a couple of months and lots of letters they have finally admitted they do not hold a valid CCA but did try and tell me I still had to repay the debt. I wrote to them last week with another letter advising them they are in default for not providing the CCA and that I would not be responding to any more letters or making a payment until I receive a compliant CCA.
I received a letter back yesterdday saying the following:
As no payment has been received and no payment arrangement has been agreed, we have stopped pursuing the debt but HAVE registered a default on your credit file! It then goes on to say how this will affect me getting credit in the future!
I checked my credit file this morning and they have already put the default on my file! I thought that they had to send me an official notice of default before they could put it on my file? I have not received on, only the letter and enclosed was a copy of the fact sheet from office of fair trading about defaults!The starting line of which states what to do if you receive a default notice threatening action! Can anyone advise what I do now? Can I get them to remove it as for one there is no CCA and two they did not pre warn me they just put the default straight on my file?
