Yes, I have, the OC are just not observing the CC ACT . A request to a agent of the OC still has to be complied with . Therefore the OC have committed an offence , by not supplying CCA and also by passing data to a third party . I,ll point this out to new DCA .0

I now have £12500 indispute! And i believe none of them have the correct paperwork to enforce the accounts !0

well i'm peeing myself with anticipation 12 days are up tomorrow and not one cca through the post, as yet? There is 37k riding on it not happening, my luck says 6 will hit the mat but I am still hoping. I find myself in a termoil of emotions, excitment, trepidation to name but a few, my wife on the other hand is worried that i'm rocking the boat so to speak. We will have to wait and see. Like you my guess is because the start dates of the debts are pre 2003 they have not got them. At most we are in for a bumpy ride at best my dfd is reduced from 2030 to about 2010.

Remember if a CCA is not produced the debt does not go away , just means its unenforceable !0

Just recieved a reply to one of the CCA requests . The DCA have send a copy of the application form . The OC have moved the account to a new DCA .0

Also the photo copies they sent,two copies of same form, are not clear and half can not be read. I,m sure a judge would not be best pleased if they turned up in court with copies of such poor quality! Also although the form has both signatures on it ,it does not contain all the requiered details , no credit limit etc. Also it is clearly only the application form .0

My update:
CC1: CCA Request not yet sent - no excuse.
CC2: Returned a copy of the CCA on 12+30th day! Haven't check if it complies with the CCA yet.
CC3: No CCA Return and today is 12+30th day. Will send a letter on Tuesday. But what happens now?
Bank Overdraft: No CCA Returned after 6 months, Final letter sent, no response after approx 8 weeks. What next?

Thanks for the links. I understand that Bank Overdrafts may be covered by the CCA, especially if an overdraft was an integral part of the opening of the account. This was true in my case. It's a grey area, and something i know i need to follow up on - just need to figure out how!

Overdrafts are covered to some degree by the Consumer Credit Act (CCA74), but they don't need a Consumer Credit Agreement (CCA).
The CCA acronym is used for both and it can get confusing.
