    Hi Blue -

    Just me. I would send the 12+2. I would save the SAR (and the £10 to go with it) for those who continue to play hard ball :)

  • Got a letter from CapQuest today saying that they are no longer acting for COne as they are 'unable to provide a copy of the agreement' also says that if I want to discuss the matter further to contact the Complaints Dept. Do I do anything or just leave it??

    Also after requesting CCA from BOS and them sending some stuff out they have sent the application form, but before I send out an Account in Dispute letter as Rog2 advised I noticed that on the top of the application form it says 'Affinity mastercard card credit agreement regulated by the CCA 1974', does that mean it is enforceable or is it just an application form - sorry for being dim!

    Last question, for the mo, Collect Direct (Egg) sent a letter today, had offered a F&F but were refusing it. Said they would accept £1 payments for 6 months. I did SAR them and they sent out a copy of CCA (which I thought looked ok) and also a heap of computer screen printouts and nothing else, I have written back asking for copies of statements etc as requested, is this normal or is there anything specific to look at with EGG to make sure CCA is ok?

    Sorry for so many questions, hope someone can help.

    I have sent CCA request away to Very (shop direct) and received a reply to say that they couldn't locate a true copy so I left it the proper number of days and sent the 2nd letter recorded delivery on the 20/08.

    According to track and trace with the post office the letter was received at my local post office on that date ...however there is no delivery date on it.

    Yesterday I received a letter from Nationwide Debt Recovery (NDR)
    to say that they are acting on behalf of the above clients and want immediate payment.

    Im not sure what to do now??

    Can anyone please help?

    they cant pass your account on whilst they cant find your cca. I cca'd shop direct and they couldnt dinf the cca for either of my accounts with them.

    i cant think of the letter you need to send them now, but i would send an account in dispute letter to ndr to adv them that shop direct are in default.

    pls dont worry to much, it sounds as though shop direct know they havent got cca so have passed your account over to a dca as fast as possible!! cheeky!

    ok, just been told by the FOS that the bank ive been having the biggest fight has admitted to them that they DONT have a signed agreement at all. FOS has advised me that i could happily let it go to court... i dont wanna just walk away from it, but cant see them accepting F&F either..

    Im actually shaking from hearing that they have admitted the dont have it.. its the biggest debtor too....

    any advice on what to do now?

    Hi, I have just received a letter from TSB this morning, and wondered if someone could have a look at it, not sure if its a true copy of my cca because im not sure what i should be looking for.

    I have to send the 12 days follow up letter for 3 accounts but due to the postal strikes in London they have not been sent yet.

    I was going to sent them today but delivery collections are still limited due to the strike action and I do not want them to get stuck in the backlog.

    If I sent them on Monday when the mail is back to normal will it still be okay because the 12 day period was up on one account on the 7th September. and the other two accounts today on the 10th September.

    I don't come in here too often now.

    Scarednshakin, I would only contact CapQuest again if they try to pursue you for payment, otherwise don't waste your time with them.

    A pub menu could have "this is an agreement regulated by the CCA 1974" at the top of it - it doesn't mean it is a CCA. 99% of application forms are not CCA's - they would need to have all the required prescribed terms on the document for it to be properly executed and enforcable.

    That may be all the information that Collect Direct have on you. I'm not sure who they are so don't know if they're part of Egg or a seperate organisation, but i would have though that if the debt had been passed to them there should have been a notice of assignment as well in there - giving them permission to collect the debt.

    Did the CCA have all the signatures and required terms?
    Have you made any payments to them and were these listed on the screen prints?
    Have you been making payment towards this debt?

    Hariboh, you could* send a letter to NDR stating that the account is in dispute and should not have been passed on to them (against debt collection guidelines). There is a letter on the standard templates thread.

    * It would depend on who their client was i suppose. If Very handed the debt back to Shop Direct, SD may have appointed a new DCA. As you have not sent a CCA request to SD, then i suppose there is not really a breach of the guidelines. You may need to send a CCA request to both parties.
