    I will dig out my original paperwork to see when the account number changed. If this looks as though it is around the same time I will take it on the chin then. Thanks for your help Stapeley :)

    Hi, i guess this is a bit of a "bump", but I also have another (yes, another !!) question : I have now received a signed CCA from RBS, it has three pages and on the signature page has customer, purpose and amount of credit, total credit and total charges and interest rate, number of repayents, and charges on default (which it basicallys states will be banks expenses incurred in enforcing agreement). Again, this looks fine to me but I would be extremely grateful if some kind person could just confirm that this is so ??????????

    Im so sorry but am bumping this again as desparately need to get sorted with CCA's before I arrange my DMP - am presently being charged more interest than my minimum payment each month on the MBNA card and its really mounting up !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! thank you to anyone who can help :j
  • Send an SAR, the CCA requests are a bit of a waste of time as they do not need to be signed.

    Just a quick bit of advice. I requested my CCA's at the start of the month and have only rec'ed T&C's from all the creditors. Should I request SAR or just go ahead and send the 12+2 letter?

    Sorry to be a pain but my head is in a pickle with trying to reclaim PPI insurance, charges and manage my DMP:eek:.

    I'm hoping someone here can help me out. I sent a CCA request to Marbles credit card a few months ago, they replied stating they were unable to provide it but would forward it to me if it became available. I didn't write to them again about it as at the same time I set up a DMP and Marbles froze all interest and charges on the account.

    This week they have finally replied to my CCA request and sent me the following -

    By the looks of it this is part of my original application form from 2000, it has my signature and it is signed and dated by someone from Marbles but it is such a poor copy most of it is unreadable. In their letter they describe this as "a copy of your reconstituted version of the executed agreement". They also sent me a copy of my current terms and conditions and a signed statement of my account.

    Can anyone tell me if what they sent me is enforceable ? If it's unenforceable what should I do next, send an account in dispute letter ? I do want to carry on with my DMP payments but these will be reducing this month onwards so I have a feeling Marbles might start being awkward to deal with so I'd like to know all my options.

    My OH is on DMP with Payplan. One of her loan is with Barclays with whom she took the loan with PPI..This was in August 2006.
    Now, please can someone advice , whether she should CCA or SAR to Barclays.Will this loan be enforceble. Also shall she claim her PPI back first and then only send CCA or SAR.
    Also is there any time span when should they send u the default notice.:mad:

    CCA request should be replied within 12+2 days. This is not enforceable and just send them 12+2 letter.

  • Send an SAR....That's a copy of the application form not the agreement it doesn't have the prescribed terms on it.

    CCA requests are no longer effective they just send you any old rubbish that vaguely resembles what you would of had.

    SAR will flush out the truth.

  • Got a letter from CapQuest today saying that they are no longer acting for COne as they are 'unable to provide a copy of the agreement' also says that if I want to discuss the matter further to contact the Complaints Dept. Do I do anything or just leave it??

    Also after requesting CCA from BOS and them sending some stuff out they have sent the application form, but before I send out an Account in Dispute letter as Rog2 advised I noticed that on the top of the application form it says 'Affinity mastercard card credit agreement regulated by the CCA 1974', does that mean it is enforceable or is it just an application form - sorry for being dim!

    Last question, for the mo, Collect Direct (Egg) sent a letter today, had offered a F&F but were refusing it. Said they would accept £1 payments for 6 months. I did SAR them and they sent out a copy of CCA (which I thought looked ok) and also a heap of computer screen printouts and nothing else, I have written back asking for copies of statements etc as requested, is this normal or is there anything specific to look at with EGG to make sure CCA is ok?

    Sorry for so many questions, hope someone can help.
    :idea: Had lbm, switched it off too many times. Now am trying to sort my life out :T:T
