    They do not need to send the actual signed copy for a CCA request...but they do if you send for a full SAR request.

    i requested a sar from barclaycard and cap1 and never received a copy of the signed credit card agreement.should i have?barclaycard have only gave me statements dated back to 2007 even though i sent a sar request

    An SAR request should of given you everything sounds like they don't have the original signed agreement,and should be enough for you to put the account into dispute.

    Hi, i guess this is a bit of a "bump", but I also have another (yes, another !!) question : I have now received a signed CCA from RBS, it has three pages and on the signature page has customer, purpose and amount of credit, total credit and total charges and interest rate, number of repayents, and charges on default (which it basicallys states will be banks expenses incurred in enforcing agreement). Again, this looks fine to me but I would be extremely grateful if some kind person could just confirm that this is so ??????????

    The guy put a CCA request in a few weeks ago, but the 12+2 letter didn't get sent, then a couple of weeks after the 12+2 date a reply arrive containing what I *think* is no more than a photocopy of the application form, not a valid CCA. Not my area of expertise, though, so a couple of questions:

    1. Is the document not a valid CCA, as suspected?
    2. Even if it was, because it arrived after the 12+2 deadline, would it be considered in dispute anyway, despite the 12+2 letter not being sent?

    Just wondered before I merrily send off my letters - if someone could answer the point above. If I have signed a CCA for a specific item on extended 0% terms does that apply to the entire account of just one specific item. This is around the time we originally bought a TV from them. Thanks in advance - hope I'm not gubbed here:rolleyes:

    YES , if it complies with all the terms laid out in the CC ACT . What ever these companies say about supplying terms and conditions that were current at the time , if they do not hold a copy with your signature , they should not be able to enforce the debt . If they tried to take it to court they would need to produce the original signed agreement . And my experience is that very few companies will still have these . What they may have is copies of application forms and in some cases very poor copies of agreements that have been put on microfilm and are not able to scan or reprint very well . These would not be good enough for the courts.

    Thanks Stapeley, sorry to sound dim but I've just finished nightshift! The agreement they have sent me I've scanned and uploaded to photobucket (my post with this link are on page 195). This agreement I believe is what they sent me around the time they changed my account number. Does this make the entire account enforceable, as this is not the ORIGINAL executed agreement. Or - are you agreeing that without the original agreement its not enforceable.

    The copy they sent me looks enforceable, but certainly is not the ORIGINAL. Thanks Stapeley, sorry for being so dim :)

    As with renewing any contract , if you sign and date , any terms within this new contract become valid. Alot of companies realised , abit late in the day , that they wer sitting on unenforceable debt . They sent out new cards and new CC Agreements , asking that they be signed and returned to them. If you were amoug the few that bothered signing and returning these new CCA then they are enforceable .
