    Hi everyone could anyone help me with my next step? I have sent a CCA request to HSBC, they asked me to sign it, so I did, they have since not sent me anything, and its been 2 months. I have sent them the in dispute/default letter but they still have added interest to the account twice. I also tried unsucessfully to reclaim PPI as it was misold to me, they replied by sending me my "agreement" to prove Ive signed for it. However, the credit agreement I have been sent (from the PPI claim)contains none of the prescribed terms and Im pretty sure its unenforable. Im pretty sure this is why they are reluctant to send me it in regards to my CCa request. Ive been told by someone on another forum who has been a great help, to now do a SAR as they have not responded to my request. Can I bypass this bit as the PPI dept have sent me the agreement? As in can I send them a copy and say "is this it then?" sort of thing? I need to be sure that this IS my agreement and that nothing is missing in case the PPI dept just sent what they felt relevent to the PPI claim. I feel a bit stuck! Any help would be appreciated thanks.
    November £10 a day challenge. Im starting early- 66p so far!

    An SAR is the next logical step, if you have a valid reason to dispute the debt, for whatever reason, if they fail to respond to that the next step is to file a request for info under 31.16 of the civil procedure rules, but we shall save that for if its needed, as it is something to be used with caution, and you must exhauset all othe avinues first to stack the odd as it where before comntemplatng a request for info under 31.16 anyway
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    okidoki, is there a SAR letter template on here at all? I have done a search but cant seem to find what to put in the letter. EDIT- think Ive found one now.

    Im jealous, i wish i could have got them to admit, in writing, they where up s**t creek without a padle.

    But if companies house is right, i may have something better, i just wish i could trust what i have been told.

  • Hi!update on my CCA requests (in case anyone is being harrassed by the companies):Kays - Admitted no CCA immediately, no payments been made since Aug 08, although statements adding interest etc were still sent for few months, now all is quiet.Additions - Admitted no CCA immediately, no payments been made since Aug 08, although statements adding interest etc were still sent for few months, now all is quiet.Littlewoods Direct - Admitted no CCA immediately, no payments been made since Aug 08, although statements adding interest etc were still sent for few months, now all is quiet.Empire Stores - Admitted no CCA immediately, no payments been made since Aug 08, although statements adding interest etc were still sent for few months, now all is quiet.Grattan - Admitted no CCA immediately, no payments been made since Aug 08 did sell on to various DCA until I complained about account being in default, now all is quiet.Barclaycard - No CCA just a blank application form but at mo am still paying them a small amount each month as they were very accepting of my offers, froze interest immediately.Am EX - Sold to RMA who have been fine to deal with, no CCA provided just an application form at mo am still paying them a small amount each month as they were very accepting of my offers, froze interest immediately.Marbles- No CCA at all, just current terms and conditions, was paying every month until they sold debt to 1st credit who wanted immediate repayment of full debt. Pointed out account was in default, so they sold it to Capquest. Now been sent unsigned CCA with my name and address but someone else's account no and credit limit on. Haven't paid anything since March 09, waiting to see what happens next. I do have other creditors, debt at LBM was 72k but dealing with them one at a time. Will request more CCA's etc if they get difficult IYSWIM x

    Dont give up on the ppi reclaim!!!!!:eek:

    Being refused by a creditor is par for the course with this.

    A credit agreement showing that you agreed to it means nothing. What if you were told that the ppi was compulsary? Obviously the box would be ticked if it was applied to the loan or credit card!

    If you have been sent a final decision from the creditor, you now need to complain to the Financial Ombudsman. Currently over 90% of ppi complaints sent to the FOS are being found in the consumers favour!!!:D

    Look through the reclaiming part of the site for more information and links to the FOS template complaint letter!

    Please, dont give up on this, you could most probably still win!:T

  • Well naughty Moorcroft have either sold my debt on or returned it to HBOS who have passed it to someone else, I have no idea how it got to where it is now, but it has, nobody bothers writing to keep you informed of what is going on..... Maybe I should write to the snotty woman at Moorcroft who wrote to me all the time, asking....haha!

    Anyway, I shall be sending the Account in Dispute letter today to the new DCA, see what happens, more waiting games I guess.....

    Thanks to everyone in this thread for their brilliant help, were it not for you, I think I would have gone crazy with all these bottom-feeders by now :T

    HI Guys,

    i know this isnt specifically CCA related, but im desp for someone advice.

    a bank that had accepted my token payments ahve now just sent 2 letters advising they are sending a 3rd party agent to my house next week. I dont want to call them and let them know the tel number but if you with hold it it wont connect the call!

    its still with the bank, hasnt been passed to dca or anything, i have proof that they are accepting the payments, but im really scared now... what should i do now???
