    have you not sent the template letter from this site regarding signatures..?. I don't have a link to had but i'm sure fermi or someone will be along soon with a link.

    It wasnt an on-line application, and it was definatley way before 2006, think around 2001-02.

    If they must have a sig use this, scanners/copiers dont like it, and makes it near imposible to scan and copy your sig, use in a word doc, size it to suit, PRINT IT IN COLOUR then sign over it, but only IF you can scan what you send them, for proof;)
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    Previously requested CCA from Link financial, told it would take 30 days to get it from original creditor MBNA. 30 Days have passed with nothing from Link Financial? Any suggestions what I should do now? Sorry if I am asking already posted questions, all a bit new to me.

    There is a template letter you can send , but I would just sit tight for awhile .

    Well the phone bombardment has started including a lovely lady who told me I couldn't read, to go back and read up on CCAs. I am apparently unreasonable, don't listen and have to pay up.
    If I am unhappy with this I can put it in writing to them, again they have no explination as to why my letters are being ignored. they have two statements to make which they repeat over and over.

    Edit Its Marks and Spencer. and the charges they are adding to this disputed account are going up and up.

    Ok, Ive signed the CCa request over an anti tamper image and in thick pen, as HSBC kept saying they needed a signature, I am also claiming that I was mis-sold PPI as I was. HSBC are already over the deadline for producing the hsbc and Ive sent them the account in dispute letter. The people dealing with the PPI claim have sent me a letter basically saying "No" but, they did send what appears to be the CCA to prove I signed up for PPI. it is two pages, it has my signature, the banks signature, my additional cardholders signature, but it doesn't have credit limit, payment details, APR or anything like that would this mean that its unenforceable and thats why they are taking so long to send it me with regards to my request? the account is from 2004 btw.     Hi maldini - just forget what Link Financial have told you regarding the '30 days' that it will take for them to get the cca from MBNA. That is a diversionary tactic on their part - purely intended to divert your attention away from their legal obligations.
    If Link Financial have been pursuing this 'alleged debt' then it is Link Financial who are obliged to provide you with a true and compliant copy of the executed Consumer Credit Agreement within 12 working days of their receipt of your request and payment of the £1 statutory fee. It does NOT matter whether they are the original creditor or not.
    They have, blatantly, failed to honour their legal obligations, under the terms of the Consumer Credit Act, 1974, and are now 'in derfault'.
    Whilst they remain in default, they must not attempt to pursue the 'debt', nor can they add interests, enter a default on your credit reference file or pass details of the 'debt' to another DCA for collection.
    You are not obliged to do anything, but in order to clarify the situation, I would suggest that you send them the standard 12+2 day 'in default' letter that you will find in post 6 of the following thread:

    Hi BH - I think that M&S are heading towards a confrontation with their arrogant attitude towards, and lack of respect for, the Consumer Credit Act, 1974. :mad: :mad:

    They have absolutely no right to add charges or interest to your account whilst they are 'in default', but I imagine that they are relying on your, and others, ignorance of the Law and reticence to take it to its full conclusion.

    Just for info, a while ago I asked 1st Credit for copy of CCA, sent all the appropriate letters etc. They responded by saying they had passed account to another company.

    At the time I had started a DMP with CCCS so gave them this information, every time CCCS try to contact, it is returned with incorrect account information quoted.

    In March I received a letter from Citifinancial stating that they had passed my account to a DCA, since then I have had letters from 3 different companies all stating they are acting on behalf of Citifinancial. I have never had an account with Citifinancial, who apparantly used to trade as Avco, so do I now have to start again and contact Citifinancial, or do I have to send £1 to each of these companies/

    Even though I know they can't produce a CCA with my signature on as I have never had an agreement with any of these companies.
