It certainly is not any good to base a court case on, and as far as i am concerned by the letter of the act does not comply with the CCa request either, but as i said its not hard for them to get round that one:rolleyes:
But that does not mean once challanged they may not find the real copy anyway, its just a question if they do is that enforceable
They can dance around sec 3 as much as they want but if they want to enforce it they will need to produce something with a signature on it to stand a chance.

Hi all.
Just had a second letter back from Capital One saying they have complied with my request (although they haven't as they only sent current T&Cs and not those at the time I took out the card). Their letter states they will still be pursuing payment as they say they are not in default. They also say this is there final response and I have 6 months to take it up with the Financial Ombudsman service. Is there a standard letter to send to the FOS to try and get them to make a ruling and explaining what the complaint is about?
