I'm told that is they way the OFT look it as well. But despite asking, they won't confirm that. To me anyway.

To be honest i have stared at that paragraph for ages before, and i can not see how it could be twisted to mean it any other way:confused:

Of course its only a mute point anyway as the creds will just add your name and address to a blank form to make it comply:rolleyes:
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

Given the advice on this site, many defendants could give them a run for their money

I think getting a judge to read it at all would be an improvement;)

It certainly is not any good to base a court case on, and as far as i am concerned by the letter of the act does not comply with the CCa request either, but as i said its not hard for them to get round that one:rolleyes:

But that does not mean once challanged they may not find the real copy anyway, its just a question if they do is that enforceable:confused:

They can dance around sec 3 as much as they want but if they want to enforce it they will need to produce something with a signature on it to stand a chance.

Trouble now is it is a gamble, just because they have not sent a real copy does not mean they dont have it......somewhere, but then again it might:confused:

No need to hurry. Seems to be in a "lull".

  • Hi all.

Just had a second letter back from Capital One saying they have complied with my request (although they haven't as they only sent current T&Cs and not those at the time I took out the card). Their letter states they will still be pursuing payment as they say they are not in default. They also say this is there final response and I have 6 months to take it up with the Financial Ombudsman service. Is there a standard letter to send to the FOS to try and get them to make a ruling and explaining what the complaint is about?

    Many thanks
