Hi please help just had CCA back from Barclaycard, and all they send was copy of general terms and conditions. However their letter stated that my agreement was also enclosed. Should I contact them and tell them this was omitted and to re send, perhaps it is a clerical error on their part. Also they stated that the original agreement was 6850 it was not because it has increasd to that over a period of amny years Many thanks all.... what should I do now0

Hi all,
Well, it is now a couple of days past the 12+2 and Equidebt haven't complied with my CCA request. They have however cashed the £1 cheque yesterday. I'll give them a couple of more days to see if anything turns up and then send then the 12+2 days letter.
Makes me think that this is another debt without the correct paperwork!!!:D
3 out of 6 creditors sent a CCA request. One hasn't complied in 6 month, one sent a dodgy looking application form, and now this one........

The CCA request goes to the company he's paying at present.
Thanks for that. I sent 7 letters for him today-2 to CC Companies and 5 to DRA'S. Hopefully something will come of them or not!! He is being hounded by a company called RMA on behalf of AMEX. I told him he should refuse to speak to them on the phone and insist they write to them. Now what should he do about offers of repayment whlst waiting for the CCA's? He could probaby afford about £50-£75.00 per month in total at present. Should he offer a nominal sum whilst waiting or not pay at present?0 -
Hi, Just looking for a bit of advice/knowledge please.
I sent a cca request letter to a dca around 2 weeks ago. The 12 days had gone but I hadn't sent 2nd letter yet. I had received a form to fill in from the court regarding my loan but as I was waiting on the cca I didn't send it back, as I thought everything was on hold while it was sorted.
Today I have received 2 letters: One from the court saying that I need to pay the full balance as I didnt return the form and a second letter from the dca. The dca had returned my pound postal order and said:
"We refer to recent correspondence. We enclose herewith Consent Order discontinuing proceedings in the above matter" (the court reference)
"Please sign the order and return to us by 14th April"
So, I assume the court order will be dropped, am I correct? Anybody any idea what will happen next? will my loan the be passed on elsewhere?

You first need to contact the court, according to what you say the court had already given judgement by default, which crossed with the claiment discontinueing, so you need to make sure the default judgement has been set aside.
It may not happen automaticaly, so you need to get it in writing from the court its been dropped, if not you will need to ask the order is set asideThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

today ive received something, not sure what it is. it looks like its been torn away from something else. its taken up a quarter of an A4 piece of paper. has name and address, credit ref number and credit limit. says credit agreement regulated by consumer credit act etc, with tiny tiny writing saying before you sign read condition 11 in terms and condition, cant read anything else as photocopy bad. has signature and above box this is a credit agreement regulated by the cc act 1974. i turn page over and another photocopy taking up a quarter of A4 page, with again really small writing, with my rights, and apr for various purchases, transfers cash transactions, and charges. this doesnt have an account number or anything linking to me, except for my signature. i have other cca's and this just looks messy, and i cant read half what it does say...
can someone please confirm this is now enforcable thankyou all0 -

It doesn't sound like a true copy of the executed agreement, melie, and the fact that it is illegible is sufficient in itself to render it non-compliant.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
