Interesting letter from 1st Credit after my 12+2 days letter today.....
Re : Copy agreement/Contract

We attach an edited copy of the signed agreement in respect of the above account and would ask for your comments.
a) If you confirm that this is your signature we will of course send you a complete copy of the relevant document. We would also invite your proposals for settling this outstanding debt.
b) If this is not your signature we would ask you provide our office with a copy of your signature from an official document, (such as driving license/passport), to substantiate your claim. Please be assured that the matter will be investigated immediately.
c) Where an address is detailed that your do not reside in we would ask you to comment on whether you ever resided at the address and, if so, the period of your occupation.
d) If we believe that a fraud has taken place against you we will advise you. In these circumstances we would reommend that the matter is reported to the local Police and 1st Credit Ltd will of course co-operate fully to ensure the matter is thoroughly investigated.

Attached is scanned photocopy of my application form - interestingly the PPI is ticked ...ummm...
What loverly cheeky chappies they are. I ask for CCA and they ask for my comments!!!
Lets take each case in point.
a) I'm sure I should not have to confirm my signature in order to obtain ALL the documents.
b) I'll send them a copy of my signature - yeah right.
c) Errr I think the onus is on them to prove I was at that address?
d) How nice of them to assist in fraud - I must have seen them in a bad light and they are really nice people at the end of the day. Hold on a pig just flew past my window.
What response do you think is best. Obvioulsy there is a template for not a CCA and also one for having to provide a signature. Do I write the "non CCA" letter? The "wanting signature" letter or do I combine both?
Or indeed do I need to write back at all? They have failed to come up with a CCA so its still in default until they can prove otherwise?
Any thoughts?
Yep, I had that one too! They sent it about 6 month ago when I first started requesting the CCA.
I never confirmed anything to them and they have never sent me the unedited version, only the same edited one 4 times!!! However, i've read about others who HAVE confirmed details to them and they still haven't received any unedited documents!!!
You mention that your ppi box was ticked. That is the section of my application form that they have edited and blanked out. What did they edit out of yours?
The edited version they sent me doesn't comply with the rules and they cant even use the 1983 regulations to excuse the omitted parts.

Cheers cocker, looks like a standard letter from them. Did you reply to it at all or just leave it?
They did not edit out the PPI - they have blanked out the bank details and mothers surname and thats all. Can feel a PPI claim coming on.... today just gets better! Cheers 1st Credit - you certainly are credit to the first degree! LOL!0 -

I refered to it in another complaint letter to them about other regulation breeches and stated that I wasn't required to send them the information they wanted.
They have never actually responded to what I said about it in any letter since!!!
If the grammer and spelling their compliance officer uses is anything to go by, then there is little chance of any of their employees being very clever!!:rotfl:
I've just sent a SAR request to them because i'm fed up of being fobbed off and they have to supply a true copy of the CCA with a SAR request. They've cashed the cheque so we'll see what turns up!

l dont know if this is a good idea or not but as l had quite a few cca's to request both myself and OH, the postal orders were getting a bit pricey at 50p each so l came up with the idea that if l do a cheque from each others cheque book, so they cant copy the signature. Is that a good idea?0 -

Sounds okay to me, nova. At least if an 'agreement' was sent with a 'signature' matching that on the cheque, then you would certainly have proof of 'fraudulent practise'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Cant see the problem as long as you dont have the same creditors.
I use other halfs cheque book for my CCA requests and there haven't been any problems. Mind you, she doesn't have any debts!!!:rolleyes:
She only racked up my credit cards!!!:eek:

Yes l shall, l also found this helpful as l can keep easier tabs on whether or not they've recieved the cca request because its quicker to look at my statement on line to see if the cheque's been cashed rather than remembering where l put the track and trace reciept.!! And the Royal mail are a bit slow in recording the T&T info, before now l've had a reply to a recorded delivery letter before the said letter has been tracked or traced!!0 -
The CCA was to the last DCA, not to Egg. The DCA then sold it on to Cabot, who are still chasing me even though I sent the 'it's in dispute, bog off' letter as above. But Cabot are claiming they've spoken to Egg (it's been about 3 years and half a dozen DCA's since Egg were involved) and they apparantly say it's all been sorted. I'll just send them another letter saying I've not had any proof, and make (more) complaints to the OFT, maybe they'll take notice this time!
Does anyone have any standard complaint letters, I'm not sure the one I used last time was clear enough.Unless I say otherwise 'you' means the general you not you specifically.0
