On the CCA request front; I have no sent copies of all correspondence and a telephone call log to my local Trading Standards, so we'll see what fun that brings!

!st credit have today sent me a photocopy of the credit card application form.
Does this constitute a Consumer Credit Agreement??
Generally speaking, momo, 'An Application Form does not a Consumer Credit Agreement make'.
I say 'generally speaking' as fermi has, quite correctly, pointed out instances where an application form can constitute a cca. However, in order for that application form to constitute a cca, it must contain certain information, which you can read about in the following link:

If you are in any doubt, I would strongly suggest that you phone NDL - 0808 808 4000, CCCS - 0800 138 1111, or a Debt Adviser at your local CAB, for clarification.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi
I wrote to International Collections 3 weeks ago regarding a catalogue account that I had defaulted on. I have since come to an agreement with them and settled for a lower amount. I asked them to supply with the original CCA and the default notice. They have written to me twice saying they are looking into this and they have passed my request to their Data Protection Department. I was wondering if they cannot produce the documents I requested in the next 30 days can I ask them to remove the default and negative information on my credit file - or am I pushing my luck?
Thanks in advance.0 -

You would certainly not be 'pushing your luck' by pointing out their legal obligation to remove any 'defaults' that they have put on your crf. Just send them the letter that you will find, thanks to weller711, in the following link:

Thanks for your help.
Just can't believe these companies get away with this, makes me so mad.
Well as they say, 'don't get mad, get even'0 -
I've had cca's supplied by Coop and Amex so far. Citi Financial have 2 weeks left before their 42 days is up. I've not heard a thing from them as yet apart from statements where they continue to add interest and charges to the account, breaking the repayment programme we set up over 7 years ago.
I recently received a letter from Cabot DCA stating they had bought a debt from Goldfish, which looks like my Morgan Stanley debt. As I'd heard nothing from MS I told Cabot I would need written confirmation from MS that the debt had been sold. This hasn't arrived so I cca'd Cabot. I received a letter from Cabot today saying that they do not have to respond to a cca as they are not affected by such a request and have returned my postal order for £1.00. They have said that they have requested the cca from MS however and I should receive it within the next 12 days. Do I bother sending the postal order back and tell them they are governed by my cca request or do I just sit and wait to see what transpires.0 -
If like me you can not pay anyone anything , sit tight . When and if a get a court claim I will use none production of a CCA in defence . I will also at that time request all monthly statements and all deeds of assignment . GOOD LUCK0

I've received copies of my credit card statements from Cahoot today with what looks like a standard letter about claiming back bank charges. They also thank me for the £10 (?what £10) I sent a £1 postal order. 12+2 up on Tuesday.DFW Nerd No 953 - Proud to be dealing with my debts0
