Might have sounded a bit cryptic- What I was trying to say is your DCA and ROS could well be one and the same.0 -
About time for an update I feel!
Here goes:
30.01.08: CCA request posted to Lowell Financial
19.02.08: 12+2 days passed, reminder letter sent
20.03.08: Lowell send my application form, with not a whiff of the Consumer Credit Act prescribed terms about them. (AND LATE!)
05.04.08: I send a letter telling them they have not provided a true CCA
06.04.08: They write to me threatening litigation
10.04.08: I send another letter telling them they have not provided a true CCA
14.04.08: I write to OC asking for statement of charges applied to original credit card!
14.04.08: I send an official complaint to Lowell about their persistant phone calls.
Guess what, just to p*ss Lowell off even more I'm going to reclaim £600 worth of charges!LBM: 14.01.08 - Debt at 25.04.08: £7420.925.06.10: 3200.00 :T I'm over half way there!!! :j

Doubt if you,ll have any luck gettin money back , but its good no CCA . With claiming money back from CC COMPANIES I believe you need to not be indefault .0

I have requested CCA from Welcome - They have sent half and admitted they cant copy in full as they have shredded it.
And requested from Capital One, recieved today well past the 12+2+30, but it seems to be to the prescribed terms. They were very naughty though, and dated the letter within the time frame required, so I have kept the franked envelope (as I usually do) to show the post date. I was surprised to find that my CCA includes front loaded interest, is that normal?!0 -

Ok update time.
!st credit have today sent me a photocopy of the credit card application form. it has not been signed by the creditor (Halifax bank) it is only stamped with 'recieved' with a signatre next to it no where near any part of the agreement section towards the bottom. it actuallty also has an old address pre-printed only adtional info that has been filled in by hand is first name, phone number, job title, salary and a date and sorta signature.
Does this constitute a Consumer Credit Agreement??
While they have sent it there is no date on the enclosed letter and it wasnt even sent recorded delivery so if this is a Credit agreement then i might never have actually recived it...
where do i stand now??

On the CCA request front; I have no sent copies of all correspondence and a telephone call log to my local Trading Standards, so we'll see what fun that brings!
