    Hi all,

Well, after hearing nothing from Lloyds TSB for a couple of month regarding the CCA request (and several other complaints) from my credit card account with them, I sent them the "Account in Dispute" default letter a couple of weeks ago and have today received the following letter from their Card Operations Customer Service Recovery Centre.

    Dear Cocker100,

    Complaint Reference: ******

I am sorry that you have had cause to complain. Thank you for bringing your concerns to my attention.

I have arranged for a member of my Customer Service Recovery team to carry out an immediate investigation, so that you will receive a full response from us. Because of the issues you have raised, it may take a little time to gather all of the information together, but we will respond to you within 28 days.

In the meantime I have enclosed a copy of the Bank guide "How to Voice Your Concerns" which gives you more details about resolving your complaints with us.

    Yours Sincerely,

What should I make of this? I have never been issued with an actual complaint reference number before now, and this doesn't look like a stardard template letter. ( It is hand signed) It may be just co-incidence, but I have stopped my DMP payment to them because I was fed up of their continuing non compliance and it is about the right time in the month for the payment to go through to them.

Have they now realised that I am actually quite serious about this and have finally started to take note or is it just another attempt to fob me off?

    Any ideas?

    Cocker:)

    Hi all,

I've just had a most bizarre thing happen!

I have tonight received a credit alert from Experian through email. It was saying that there was a change in the payment history of an account.

Have logged on and found it was for my Lloyds TSB credit card.

Bizarrly, it was stating that the account had been "settled" and the balance was now zero!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! IT WAS over £6500!!!!!

What am I to make of this???????? I've not had anything in writing from Lloyds. I will be eagerly awaiting the post in the next couple of days.

I'll keep you all posted as to the outcome!

The request must be made in writing and accompanied by a
fee of £1, and the creditor must respond within 12 working days (unless
a similar request was made within the previous month).

Within 12 working days - I would take that as "within 12 working days of request" i.e. they must reply within 12 working days the day they recieved it. So you allow 1 day for them to post it back which would mean you recieve it on the 12th working day (but have you ever know a DCA to post first class? yeah right!

So the way I read it - you post - you have proof of the day they signed for it - they then have to get a reply to you by latest the 12th working day from receipt. Does it really matter? if they aint got a reply within 7 days they aint got it!

By the way - my CCA request is to 1st Crudit - today is the 7th working and nothing back - at least lowell-life did write within a couple of days saying they would be looking for it. Anyone else had any dealings with 1st Crudit and CCA request? If so did you get anything back within the 12 days?

    Hi,

Yeah, I've had dealings with the notorios 1st credit DCA! They are dealing with my former Morgan Stanley (Goldfish) credit card.

I originally sent a CCA request to them about 4 month ago, but all i've had back from them was an edited application form and nothing else!

I complained to their Compliance Officer and the request has apparently been sent back to OC, but still received nothing back.

They are well in default now!:D

  • First Crudit wrote to me 6 days after my first CCA letter, telling me they couldn't find the CCA. I then sent letter two on 24th November and have heard nothing since!

Holley - If they are refusing to provide a copy of the CCA, report them to Trading Standards. I think it's the TS for the DCA's area.

    Cocker:)

I have used all three Credit Reference agencies (via www.checkmyfile.com) and I also had the same thing on one of the agencies but not others (I think they all store your information differently which is why most lenders will use all 3 to get a financial picture of you). I still get DCA's pop up every now and then even though it was reported as "settled".

I'm not entirely sure (hopefully someone may be along to clarify it) but I would guess that the OC has written of the debt and sold it on so in their eyes its "settled" however I have had DCA's then have their name against the same debt on my Credit File. And trying to remove that after they fail to provide a CCA is a nightmare!

Either way having a "settled" on your file cant be a bad thing! :D
  • Hello - would anyone be willing to share a complaint letter/template that they have used/seen to complain to trading standards about a DCA not complying with CCA requests?
