    I get the feeling they go after the 'soft' targets first, i have had the same, no responce from LTSB to any letter i sent them, including a CCA, followed by threats from Sechiari, Clark & Mitchell Solicitors, told them LTSB where in default of a CCA request, all of a suden i get a letter from LTSB, a month and a half later i get an unreadable alleged agreemant, which does not comply with the CCA act.

    More threats from Sechiari, Clark & Mitchell Solicitors, told them what LTSB have sent is a load of rubish, sent LTSB a formal complaint, then nothing since november last year:confused:

    LTSB are not very good at communication, or following the rules:rolleyes:
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
  • I had a knock back in my case from the FOS who said that it was not really an outlet for these types of disputes to be resolved.

    I still have my PPI reclaim with them awaiting for a decision, but in respect of the CCA matters, the decision was not what I wanted (it was what I expected though!)
    Almost debt-free, but certainly even with the Banks!

    In all honesty. NO it's a living hell not knowing what is going on. At least when something is being paid there is a level of control. When no-one will take payment but still demand acknowlegement of the debt it does your head in. Still in 5 years 8 months it will drop off:rolleyes:.

    Hi all,

    I sent a CCA request to Aktiv Kapital months and months ago. Hear nothing until today.

    They have said
    In your recent letter you have suggested that the account has nothing to do with you and have requested documentary evidence, such as a copy application form.

    Under the Data Protection Act, we are unable to disclose personal details. You claim the account is not your and we would therefore be in breach of the Data Protection Act if we were to disclose any details of this account to you at this stage.

    In order that we can investigate the matter, please forward a copy of an official document, which shows your name, date of birth and signature. In addition can you please provide us with your previous addresses since 2004.

    On receipt of that, we will investigate the matter further and revert back to you.

    A pre-paid envelope is enclosed for your convenience and we will look forward to hearing from you as soon as possible.

    What should I do? They dont seem to have anything or Im sure they would have sent it wouldnt they? Also they didn't include a pre paid envelope as the letter says.

    I would reply- i will provide a copy of an official document, which shows my name, date of birth and signature once you send me a copy of an official document (such as a CCA for example) to prove you have something to compare it against;) :p

    A[L]C - if they are not sure your owe the debt, they shouldn't be chasing you for payment in the first place. If they are sure you owe the debt then they shouldn't have a problem in providing the CCA.

    Do not provide them with anything that has your signature on it.
    Do not phone them - or they will constantly call and harass you.

    You have provided everything required of you form the Consumer Credit Act when requesting a copy of the CCA with £1 fee. They are in breach of the Act by not fulfilling their legal obligation.

    When was the last payment you made towards the debt?
    Was there ever a period where no payment had been made for 6 years (5 in Scotland)?
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    No unfortunately not.

    So should I just ignore them for the time being? From what I can tell they're in breach of the cca request so cant legally pursue it.

    You could point out a COPY OF A SIGNED CONSUMER CREDIT AGGREMENT was requested and a copy application form is not satisfactory .
