You may have to watch this one, natters - It is an all too common practise for a dca to use the £1 as a 'payment' towards the alleged debt, in order that they can claim that you ave, by making this payment, acknowledged the debt.
Keep ALL correspondence in case this 'person' tries the above approach.

I always add to my CCA request (and I underline it!!!) the following

"the enclosed payment is not to be used to reduce any alleged outstanding balance"

I find this usually works for me - it they do they you have something else to help hang them out to dry!

Many thanks Rog for the info in your previous post - I now have another question - said company rang me this morning I told them that they needed to send me a copy of the cca as requested in my letter, the guy got really shirty and asked me if I understood their letter telling me to apply to the OC - I told him that as they were persuing me for payment they were the ones that had to provide the cca - he then asked if I was some sort of legal expert and told me I didn't know what I was talking about and said we don' have to supply a ccc - or whatever it is you want (great that he doesn't even know what it is himself!) - I told him I did know what I was talking about and his company were legally obliged to send me the information - at this point he starting yelling at me that I owed RBOS money and they wanted it back - this was when I put the phone down on him.

So I really want to know if what I said was right, and if I need to do anything except wait out the 12+2 (they also never returned the postal order with the letter saying they couldn't produce a CCA, so I am assuming it was cashed.)

Thats not 1st Credit DCA you are talking about is it?

That just sounds like the type of scum that work there!

Under-educated morons that have to resort to shouting to try and get their words out.

Just as an experiment (and I indend to use it myself when the chance arises) is :

When they start getting shirty just say hold on one second then press a key or 2 on your phone (needs touch phone) so a couple of audible bleeps are heard. Then say "I have just started to record this phone call for my records".

Wonder what their reaction will be? I got the idea from work since we have put on a recorded message saying "all calls will be recorded...." we have found that the number of DCA's (we deal with customer who having utility billing problems amongst other things) who call has reduced or they are alot more polite on the phone. My guess is if your try the same thing then they will either hang up or suddenly become polite - the last thing they need is their bullying behavour recorded to maybe be produced in court at a later date.

Worth a go? Anyone else tried it?

Hi all it has been a while

Just a quick observation of the last few posts:

Why are you speaking to them??????

Be polite but don't answer the security questions - if you do want to speak to them put it in writing - you don't have to speak to them, remember you are in control.

When you first start off on this track you become inpatient but as time goes by you start to relax. When the threatagrams come in look for the key words, may, might, could etc before jumping to concluesions.
    June 2005 = 48K of Debt:cry:
Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

Happy so far tomorrows another day:confused:

I only speak to them if I am in the mood to - their threats and shouting doesn't bother me, and in a sick sort of way I enjoy winding them up!

Back to the CCA requests - I have now recieved 2 more replies - one from Redcastle they returned the postal order along with my letter and a compliments slip saying this account is now closed and has been passed back to the client.
The other from Apex saying formal notice of defaulting account, we are contacting our clients with regard to seeking their approval to the issue of a county court claim against you.

I assume for both of these as with Newman I wait until the 12+2 days is up and send the next letter?

Thanks again for your help and suggestions - they are much appreciated
  • Hi all,

Has anyone sent a CCA request to Tesco Credit Cards recently? Does anyone have an address to send the letter off to? Looked at my most recent statement, but all that is on there is their registered business address.

I've defaulted on this account and it is now part of a DMP, also i've heard that Tesco are now not part of RBS anymore, so dont want to send it to the wrong place.

  • Well still no word from Barclaycard, despite many deadlines passing, my final dispute letter telling basically to stuff off, gives them until next Friday... I guess something must be happening, as I haven't heard a peep from Mercers, Calders or whoever BCard are masquerading as at any particular time since end of December!

Got a letter from FO to say they were still looking into it so who knows what the hell is going off.....

    Thanks for your reply.

Just noticed that this is the same address (PO Box)as is on the back of the envelope of my statement. (i.e. if undelivered please return to........)

However, I had a finest platinum card, not a clubcard credit card. Should I just amend that line or delete it?

(P.S. Cant click your "thanks" icon, my computer never lets me, it just disappears if I do!):o
