Hey guys!

Hello - I am not really familiar with the requesting CCA process, but have sent my initial letter ( got it from the National Debtline website) and my letter has been successfully delivered 5 days ago.
I don't want to get ahead of myself, but I wondered if anyone had any experience of JDWilliams catalogues, and how likely they are to respond ? I have had the account for many years - probably getting on for 9 or 10 - and have been paying reasonable sums each month to clear arrears from last year, but they have started asking for more and at a frequency I have never agreed to.
I just wondered if they would produce a CCA, and if not, is there a link to something I can send after the 12 + 2 days. I have read all of this thread, but I'm still not sure what gets sent at the 12 + 2 day stage and what ( if anything under the changed rules) gets sent at 30 days after that.

No JD williams are unlikely to produce a CCA at all
But they wont give up, but you can ignore them once or IF the admitt to not having a CCAThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

I've had exactly the same situation with JD Williams, they didn't have a CCA but were very very persistant. Eventually passed it onto NDR who added another £65 immediately.
I wrote back and asked them to return it to JD Williams as it was in default which they did but then I started getting letters threatening home visits etc. The thing is I wasn't trying to get out of paying just geting fed up with additional charges etc increasing my debt whilst I was on a payment plan.
However.... I wrote to them saying that of my now £650 debt I only acknowledged £300 as the rest was charges, NDR's fee etc, and as they didn't have a CCA I offered £100 in full and final settlement. They jumped at it, and its now marked as paid on my credit report.
I'm now hoping to do this with all my other creditors. I 've requested CCA's from all, most haven't got them but have carried on paying each month whilst getting charges, PPI refunds etc taken off the account to lower the total. Am now planning on pointing out the lack of CCA and offering very low full and finals.
Don't know whether this would suit everyone but I feel guilty about opting out of paying if no CCA's but want to pay everyone off with as little as poss if that makes any sense! x0 -

I have lokoed at your other post,and to be honest it makes no senseHi all i am new to this so please bare with me. I am trying to sort my partners finances out (the joy!).We got his credit file from credit expert and have noticed that there are three enteries for an account opened on one day.
We belieive these three enteries are for the same account. One entry says settled and the other two are defaulted. We have therefore contacted Cabot who had sent a letter asking for the money and explained the situation. They sent a letter on 12th Jan stating they have contacted cityfinancial whom have the satisfied account. They said it will hopefully only take 21 days but could take longer. Does anyone know how much longer they are allowed to take???

The OC can issue a default, but the DCA can not unless you default on a repayment agreement with them, and they can only do that if the debt has legaly been assigned to them under an absolute assignment

Just to say that I don't want to ignore them - I will be continuing with the payments, but I just want to make them at my pace, not theirs.

Many thanks Rog for the info in your previous post - I now have another question - said company rang me this morning I told them that they needed to send me a copy of the cca as requested in my letter, the guy got really shirty and asked me if I understood their letter telling me to apply to the OC - I told him that as they were persuing me for payment they were the ones that had to provide the cca - he then asked if I was some sort of legal expert and told me I didn't know what I was talking about and said we don' have to supply a ccc - or whatever it is you want (great that he doesn't even know what it is himself!) - I told him I did know what I was talking about and his company were legally obliged to send me the information - at this point he starting yelling at me that I owed RBOS money and they wanted it back - this was when I put the phone down on him.
So I really want to know if what I said was right, and if I need to do anything except wait out the 12+2 (they also never returned the postal order with the letter saying they couldn't produce a CCA, so I am assuming it was cashed.)0 -

Unfortunately, the employees of many debt collection agencies are totally ignorant of the legal obligations to which they must adhere, when plying their often questionable trade.
Instead, they rely upon their victims' ignorance of their legal rights - whether that be in respect of a cca, 'statute barred' debts, or even their right to ask the dca to 'prove' that they actually owe the money.
The person, that you spoke to, has displayed exactly those archetypal characteristics that many of us associate with their ilk.
The mere fact that he had to resort to shouting is proof that he knew he was on a 'loser' with you.
IF he calls again, just tell him, again, that he/his company are in default, and that ANY further contact from im will be treated as harrassment and reported to the relevant authorities.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

You may have to watch this one, natters - It is an all too common practise for a dca to use the £1 as a 'payment' towards the alleged debt, in order that they can claim that you ave, by making this payment, acknowledged the debt.
