Well a quick update on my CCA request.
We were getting letters from the DCA threatinging to take us to court over a catalogue debt from 1999, so I sent a CCA request to the DCA. Now we have recieved a letter from KAYS catalogue stating that they have no CCA agreement and attached the current terms and conditions.....of course unsigned...
So we will be contacting payplan in the morning regarding this letter.0 -

The debt is not statute barred, as we have been paying fredriskons £40 a month, until we joined payplan, 3 months ago.0 -
Ok is this legal? I requested my CCA from next back in may, it was going through moorcroft. They said they did not have the CCA, and I did the usual default thing, Heard nothing else until today, I get a letter from another debt collector looking the money from next, I say another debt collector but it has the exact same address as moorcroft, same font, just a different company name. I thought when they defaulted they could not persue the debt again, they have just changed there name.This is a system account and does not represent a real person. The standard "bogoff account in despute" letter would do but i would re-word it so they know that you know what they are up too;)
By using this dormant company they are trying to avoid contravining the bit in the CCA and OFT guidelines about not being able to persue the debt because it is in dispute.:rolleyes:

Hi, looking for some advice with regards the CCA requests. I sent both letters off and have received nothing back and was specific in each letter that all correspondence had to be in writing. The DCA has not stopped calling my house. I did answer one night and refused to give my details over the phone and said that I will not discuss anything over the phone it must be in writing. The chap on the other end of the phone said they have written to me (I have received nothing from them). I really need to know what my next step should be as surely if they cannot produce the CCA then they cannot harass me for payment?0
