  • Thanks Fermi, i seen the speed of a ccj with Moorcroft didnt I. I am not going to ignore letters/calls anymore as my nerves cant stand it. Everybody else is sorted, either been paid off or accepting reasonable amounts each month, it is just these now. So i think i will ring and see what the score is, inform them i have not got the full amount and see what they say. I am going to put the offer in writing to and keep copies, and if/when it does to go court at least they can see that i was willing to try to pay my debt off. I am not going to give in to an amount i know i will struggle with as i have two children and THEY are not going to suffer for my stupidity with debts. Thanks again

    Oh yes, I remember.

Just be careful if you do phone them, as many of these people are bullies. Definitely best to make sure any formal offers are in writing only.

Sounds like you have your mind on what is truly important, so I'm sure it will work out one way or the other. :)

sent cca letter to cabot on 22nd...received a letter stating they have requested from oc and sent my £1 back...also increased the amount i owed from just under 5k in april 08 to just under 8k now!!

called them and they stated that they have included the interest which would be added if i miss any payments...if none are missed they would write the interest off....slightly concerned now that if the cca is not produced within time frame and i stop payments, then it is found later i will have increased my debt by a substantial amount....

    advice please

    a very worried frazzmunch!!

That is low, very low, showing you something that they cant possibly claim in the hope it frightens you into paying.

They are trying to un-nerve you, could mean they cant find the CCA;)
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
  • thank you blind-as-a-bat..:D it certainly worked on the un-nerving me front!! nearly had a heart attack when i saw it...i wasn't sure if i was going to stop paying them regardless of whether they produced the cca or not...however, now that they are being underhand, i probably will if they don't produce it!!

I reported Fredrickson International to Consumer Direct and got an email back telling me to write to them with a £1 postal order giving them a set time in which to reply then after that to write and ask them to remove my details. All of which, of course, I'd already done. CD also told me to complain to the Information Commission which I've done, not had a reply yet.
Unless I say otherwise 'you' means the general you not you specifically.

If a CCA is not produced within time limit the account is then in dispute . While the account is in dispute no interest is allowed to be added to the alleged account !

:T After receiving a " you must pay blar blar blar to avoid court action " letter from a new DCA . I wrote back to inform them that by forwarding my details to their company the OC have committed an offence under the terms of the CC ACT. And that they by demanding payment on a disputed account would be reported . Within 6 days I received a " In view of the circumstances blar blar blar " :T do they never learn.

I would be grateful for any help with this I sent the CCA letter to DCA which they haven't supplied and I have now been sent a Notice of intent to issue court proceedings. I have spoken to this company since the CCA letter and pointed out they hadn't supplied it and I disputed the debt , what do I do now? Thanks

Did you send a default letter after the 12+30 days?
