Panic Mode

Hi Everyone,

I have finally been able to register on here, it kept saying "The string you entered for the image verification did not match what was displayed" everytime I tried to register, even though it was what was displayed!

Well here we go..

Firstly I would like to thank everyone who contributes to this site, I would have gone completely mad over the last few weeks without reading other stories..a special big thanks to "wherediditallgo" her story and strength has really helped..

My story is that after years of spending, juggling, consolidating, reconsolidating, and generally trying to live , I have got to the point where bankruptcy is my only option. I am going to court next week, and finalising all paperwork over the weekend. I am now really beginning to panic, I have always been a born worrier but now its got a bit out of control. I keep thinking of every negative scenario and convincing myself it is going to happen to me, i.e. my landlord will find out and kick me out (even though I've never missed a rental payment in 7 years) and my employers will find out and sack me, even though I do not do a job that would be affected by bankruptcy (I hope. I'm a secretary).

I know this is a course of action I have to take but it is really affecting me now. I also got conflicting info from CCCS, one consultant said my landlord will not find out as I'm up to date with rent etc., and they are not a creditor, same consultant also said I could keep my car as its a bit of a banger and worth max £800. I then rang CCCS up again just to clarify what I'd been told and the guy (who was not as friendly as the girl I had previously spoken to) so completely the opposite to me which really stressed me out :eek: !

Oh well the BR has to happen next week, so guess I should just take one problem as it arises and not think that everything possible that could happen, will!!

Any kind words, advice, support would be much appreciated!! :confused:

    Don't panic, it's easier than you expect!

    FWIW my OR told me my landlord would be informed, so I got in first and told him myself, and he was fine - he just wanted to know he'd still get his money every month!

    The car, that's always a grey area. You need to make a strong case for keeping it.

    Your job - they won't be told.

    Hi and welcome to the board Em.

    The OR can if he so feels inclinded not tell your LL. To get the odds going in your favour make sure you can prove you are upto date with the rent and show him a copy of your rental agreement. If he does say he is going contact your LL don't panic we can help you put a letter together for your LL as to why he should keep you on as a tennent.

    Cars are an oddity as they are an asset. If you can prove that your car is an absolute necessity to you ie:you can't resonably get a bus to work. Then you stand a good chance of being allowed to keep it and the associated expenses.

    If you need any more help then don't hesitate to ask. How are you getting on with your I&E?

    I am concerned about telling landlord, well actually an agency I've used for 7 years, as its in my contract about forfeiting flat if I do go bankrupt, so if they have to strictly adher to contract I guess I'm stuffed, but as I said I have rented 3 flats with the agency over the past 7 years, have always looked after my home, and have never missed a rental payment. If I were to print off old bank statements and highlight rental payments for OR, and show him a copy of my assured tenancy do you think this will stop him contacting the agency? It is also a very reputable agency, and not sure how they would feel about renting to a BR, but I am the worst worrier in the world so always always think the worst will happen..

    As regards the car, it is a actually a joint asset with my bfriend (who is not going bankrupt) but was put in my name when we bought it 3 years ago as I am a bit older than him (and a female!) so the insurance was cheaper, but he actually paid for it. I was initially told OR wouldn't be interested in the car as its over 10 years old and not worth much..If I put it into his name before I go BR will I get into trouble?

    As regards I & E, when I had my interview with CCCS the lady took down all those details and forwarded me a copy. Do I take this with me when I see the OR, and will I see the OR on the day I go bankrupt? I'm finishing the forms 6.27 and 6.28 at the weekend online on the insolvency website.

As you said highlight the rent payments and give them a copy of your agreement and ask very nicely for them not to tell the LL as you fear you may loose your house. The BR clause doesn't mean to much, they would have to give you 2 months notice and they could do that at any time if they wanted you out. If you have been such a ggod tennant it is highly unlikely they will want to get rid of you. As I said before if the OR says he will contact them then we will help you put a letter together for you to give to the LL.

The OR checks with DVLA what cars you have owned and it could cause some problems for you. Better that you write saying why it s a necessity for you both to have the car and not just a convienience.

I'm finishing the forms 6.27 and 6.28 at the weekend online on the insolvency website.You take You take all the forms to the court on the day you go BR. Phone them a see how many copies they require. You very rarely see the OR on the day of BR but again check with your court as each one operates a different system. Usually you just talk to the OR's assistant on the phone breifly and then you make an appointment for a phone interview for later on.

  • Tiger Feet..your advice much appreciated..what will be will be I guess, I need to stop stressing so much, but not easy..

    I am currently finalising the forms online so they are ready to print off at work on Monday, hope nobody near the printer at that time! :eek: :o

    I'm a bit confused with a question at step 4, its ask for dates of loan agreements etc., but I have had some of my credit cards for many years and can not find the dates of original loan agreements etc. Will they accept date of last statement and then a note saying approx month, year? I guess they will get full details when they contact the credit card companies anyway?

    Just put the approximate dates as far as you can remember and put a question mark next to it. The OR can find what he needs.

    Have you done you I&E? Has anyone looked at it?

  • Don't worry about the dates - if you don't know what they are, just put the year or even something like 3-4 years ago. That'll be fine. :)

    I had an I & E done for me by CCCS when I had the phone interview with them, then sent me a printed copy of it. Will I need to take this to court? She approximated that I would have around £195 available for creditors after my living expenses, and she said they would probably take around £100, does that sound right?

    I've been told by CCCS that the High Court do not charge the court fee, but I have not heard this before. Has anyone else?

    I'm sitting in my living room nearly drowning in paperwork, can't wait to be able to shred the lot and stop feeling nervous :(

  • I would carry the CCCS paperwork with you so that you can give a copy to the court if they want it, but keep a copy of it for your own records as you'll probably find it helpful to refer back to when you have your OR interview.

    As for the court fee, it's true that the RCJ don't charge it - I was very pleased on my day in court when I found that out. :) However, to be on the safe side you should still carry it with you, as it's almost a year since I went BR there & you'll be annoyed if you have to postpone the case because you don't have enough money with you on the day.

    Some one has just gone BR at the RCofJ and they had to pay the fee. Think it was The Editor :confused: . So I would check on this.

    Em would you like us to look at your I&E as well? Or PM it to one of us if you are not comfortable posting on open forum.
