Ii'M BLAZING!
Purchased a sat nav from Argos on aug 27th/07 and in last few weeks its been playing up with intermittent fault. Had enough yesterday, had a drive out sat nav got us there, but we could not programme it to get us back home, it just kept switching from one screen to another.
Took it back today expecting either refund or replacement.
Oh no says staff member, gotta go away for a repair to manufacturer. Adv would have no sat nav and need it, repair unacceptable.
Now reqs mngr and gets deputy mngr, he digs in heels and says thats co' policy and all i will get. Adv under sale of goods act sat nav not fit for purpose, dont want repair want refund/repl.
After long conversation where i got him to go away and get me copy of sale of goods act, he rets with copy of his co's intranet "SALE OF CONSUMER GOODS RIGHTS ON PURCHASES AFTER 30 03 2003" It has a flow chart and basically says "IS THE PRODUCT RET WITHIN A REASONABLE TIME" in brackets (a fairly short period) if yes then it says you can refund, if the answer is no it says a repair OR a repl should be provided in the first 6 mnths.
I pointed this out to DM re the "reasonable time",not being defined .He stated as they offer repairs that was all i was going to be offered.
This idiot had also tried to say that because i was using the sat nav to get to work its only for domestic/pleasure use only, and not for business use.

Anyone help, what are my rights. tried looking up sale of goods act but its all confusing.
Got his mngrs name(who wasnt in), area mngr was at same meeting. Got Sara Weller's name who is director, DM wouldn't give his full name(no surprise there then) and gave me head office tel no(wanted dir's no really).
Before i go in all guns blazing need to know wether i'm right or wrong.
Any replies appreciated.

Repair sounds fair to me.
It sounds like the sat nav is fit for purpose, however it's just broken and needs fixing.0 -
6 months old? Sounds like it needs a repair rather than replacing.. Stupid question but have you tried resetting it or reinstalling the software?0

Repair is perfectly acceptable if you have had the item since August 2007 - decision over repair or replacement is based on what would be "disproportionately costly" and it is up to the retailer to determine whether a repair or replacement is offered after this amount of time has passed. The duty manager was not obliged to give you his full name and I wish that store staff were considered special enough to have the directors telephone number. All in all, I think what you offered is reasonable and within the law, up to you whether you chose to accept that or not.0

This is just an example of you don't know what your talking about but think you do. They know that they are right and do their jobs perfectly within the law. But because you think incorrectly your right you blatantly are abrupt with them which makes communicating with you difficult.
So it all probably took twice as long as it should have, went out of hand through your own doing all because you don't know what your talking about.

I don't think the company is being unreasonable here, I think you will find that they are within there rights. if it cant be repaired then one would expect a replacement it doesn't have to be new as long as its like for like, if that cant be found then a refund would be an option0 -
It does state in the catalogue that if you've had the product between 30 days and 1 year they will repair it, if that's not possible they'll replace it and if that's not possible they'll refund you. They are perfectly in their rights to send it away for repair.
OK, you'll be without it for a couple of weeks, but I'm sure you'll live. How on earth did you find your way around before you got one. Have you never heard of maps???

I have said this before but a friend told me her student son worked at Argos one summer and he said they throw stuff onto the conveyor at busy times to be quicker!
I'd never buy anything electrical from Argos - lets face it we have enough trouble with pottery and plastic stuff from them. If it isn't packaged well it won't survivie the 'Argos experience'Don't grow up. Its a trap!
