got a letter this morning, saying i own trimph asset services £498.33
this is from a bill in 2002!
there say there have tryed and contacted be before in my old address but this is the 1st letter i have had from them,
is there anything i can do about this, as there have just put a load of charges on this without me knowing,
im very upset about this thought the bill was payed. ive never heard any thing from them in 6 years!
please help

We would point out that we have no knowledge of any such debt being owed to The Loan Company.
We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

they have to proove you owe the debt first and if it is over 6 years since you last heard from them then it could be statute barred. Looks like 5 years and a bit tho! ive been on hold for 30mins trying to get though to the company that allied international credit says i own the money to, should i write 2 letters or one?
there also say in the letter there will get bailiffs/country court/or attachement irder to my wages!You be lucky:T0 -
Just scare tactics, don't be taken in by them and stop phoning them. Why waste your money?
Can you remember exactly when you made the last payment to the company in question Triumph AS ?

i rang the company on saturday and that was the information i was given, there give me another number to ring, but thats the number ive been on hold with, around 40mins now! ive hung up now.
there said it was in 2002 it became a debt, and letters were written out to my old address were i used to live, i know that ive had them or i would be on the phone ringing them, asking what it is!
also says on the bottom of the letter,
this is a final letter and no furhter warning or intimation will be givenYou be lucky:T0 -
They cannot touch your wages! They cannot send bailifs round without going through the courts. They cannot go through the courts whilst you are disputing the debt - send the letter - they have to provide the DDA and it should have dates on there clarifying if the debt if over or under 6 years old. If it's over then it's statute barred.
Do not phone them, if they phone you then tell them you are disputing the debt and you have sent them a letter by recorded mail. If thye continue to try to make you pay then tell them you will report them to the OFT.DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

I found myself in a similar situation with my wife. She received a letter asking for more than £7000 which was owed on an old credit card apparently before we emigrated to New Zealand (back now). Although she had rung them (never do!) they could not provide evidence that the debt was still active and not statute barred. The last letter was to be patient whilst they found the old records of when a last payment was made to the credit card company. She is still waiting to hear from them 9 months on!!
In that time period they sent us letters asking us to fill in details of who we were and all sorts of information. I just sent them back asking for their personell files so that I could ascertain who they were :-) and questioning their right to my information just on a whim.
It never ceases to amaze me that when companies want to enforce the law they have a right to do so, but when consumers enforce the law we are being difficult ???!!.
Use the same laws that they are so eager to use. If they are intimidatory - report it. If they lie - report them and ask for copies of all information they have showing it is you who owe the debt and get them to list all their evidence as I suspect that when they buy these debts they do not get all the history of payments ect that they need. did the letter but got a phone call last night at 7:30pm saying "the bill is still outstanding, we will not be closeing the account, please ring me on ****** with ref number ******
Now im very worried about this as it seems there are hounding me for this, should i ring them up? i got told to ring this other number to see what the debt is but i was hold on for half an hour!

Hi,
Did you send the letter recorded delivery, so you can prove that it has arrived? I wouldn't call them if I were you-you have asked them for some information they haven't provided you with yet.
If they phone again and you answer, just say that you will only communicate with them in writing, and also keep a log of when they call you, as there are laws against harrassment. I know it's scary, but you are following the right procedure already x0
