Which fence do we own?

Thx STC,
My neighbour is trying to make us do it - but we don't really want to be responsible for something that we can't get to 'cos it's on her land/ side of the fence, she's growing things on it, it's part of her brick built shed....she's abit barking mad by the way.... I try to avoid her:o0 -
Maybe mention to her that if it is your responsibility then she must stop growing/leaning things up against it0
-
or even better, tell her that you will take it down and not replacing it.....
btw. not suggesting you do this, but may make her think twice about continuing the dispute0 -
re :the fence ownership question. You can ring the local land registry office who will have plans which indicate whos boundaries belong to whom.0

Hi
Well I would be happy to take responsibility for it TBH....but not while the trellis is attached to her side and we can't get to it properly, so she would have to take that down. Then of course she couldn't really grow so much all over it and expect us to maintain it, could she? But then how could we responsible for the wall when part of it is integral to her brick built shed?
How do Land Registry know who is responsible when there is nothing on the deeds?0 -
You should post this at https://www.gardenlaw.co.uk0

Thx Van1971 just found this on Gardenlaw.co.uk
T Marks
“T” marks can be a source of confusion. A “T” mark on a deed plan means nothing by itself. It needs to be referred to in the text of the document to establish whether it indicates ownership and/or responsibility for maintenance. A similar observation may be made about double “T” or “H” marks showing shared ownership of a boundary feature. "
There are H Marks on our deeds on all 3 boundaries of our gardens. Therefore, probably indicates shared ownership! God help us:o...I'd rather be responsible :rolleyes:0 -

Ownership and Obligations
There is a difference between ownership of a boundary feature and the obligation to repair a boundary feature. Just because you own a boundary feature does not mean that you are under an obligation to repair it.0 -
Right, think I understand now:rolleyes:- we are probably jointly responsible....but while everything is on her side from a practical stance our neighbour will have to maintain her trellis. If she insits on us taking on responsibility we will get her to take her trellis down and put up some new trellis on our side......:money:result!:T
Complicated isn't it? It's just abit of flippin trellis!0 -
Glad I was able to help.
Good luck with your neighbours.
