Good morning everyone. It's snowing here but not settling. I've been awake since 5pm!

Maz, banks have to deal with a third party as it is part of their banking code. Don't worry, we have been through this will most of our creditors. They are just trying it on but it will settle down eventually. Keep strong and keep fighting and don't let them drag you down.
Nat West have stated they will not freeze interest until our account is passed onto their Recovery Department. However when this will happen goodness only knows.
Had fun and games with MBNA yesterday, on the telephone. I have to say that they are completely unprofessional and quite childish, i.e., slamming the phone down on OH, who was being perfectly civil, so this was completely uncalled for!!!!!

Yes i thought that was the case also until i looked at the new guidelines apparently they can demand all the the money in a certain time and if i cannot pay them they can apply for a ccj and charging more or less at the same time,but i tell you what i had agreat sleep last night and not worrying ,it hasn't happened yet and I am praying it goes no further0 -

Can I ask you whether you know ?
I fi were to pay this creditor off in full to get him off my back so to speak,how much would be a reasonable offer in full and final payment ?
My dad has offered to pay them,but not sure if PayPlan will look favourably on it,but at the end of the day its our home that at risk and if it can be protected by paying 1st credit off then thats all that matters .
the debt is £22660 -
Good Morning all
thanks for your kind words WhoopieDoodle - great name.
I can see that it is going to be tougher than i thought doing my own dmp plan, rather than going with a either cccs or nationaldebtline own dmp.
However, im a bit of a tenacious old bird, so i see this is a challenge, and i will follow the guidelines and advice given to me by nationaldebtline and see what happens.
Should it go to court then the Judge will have all the paperwork from me to fully understand that i have done everything that the law says i should do.
Well good news a little light at the end of this mad black tunnel is that Abbey have agreed to revert our mortgage to a 3 yr fixed rate at 5.99 with only 125.00 fee. Spoke with my broker who advised good deal. Best of all, they have included the 2000.00 mortgage arrears so at least i dont have to find an extra 400 to clear the arrears each month.
Therefore my fear of CCJ's in part has disappeared the mortgage will be met without any trouble and if the creditors should take me to court the judge will tell what i can afford and the interest will stop anyway, so could this in my cynical way be another light at the end of the tunnel?
I do want to get rid of these credit card debts and hopefully going back to work in may see how it goes, daughter goes to college in september, then see if i can increase my hours to really tackle the reduction and give me hope for the future. (have been off ill with depression past 4 months).
Just thought id share some of my good news, we all need to see sometimes, things can suddenly change as long as we keep our faith alive.

Hi Tickertyboo. I'm in a similiar position with one of nine creditors. They are actually serving a Statutory demand on me next Thursday. I've decided to settle and like you, with help from a family member. I told the CCCS so they would know and, in this case, their advice was yes, settle. However, I think there are some possible consquences I need to be ready for. Whilst my DMP payments will increase to the other eight creditors, some might notice that I've a whacking amount off one debt. They may, just may think, "wheres our cut then?". I anticipate at least one of them coming after me for this reason, thinking I have funds I haven't declared. So, if this happens, I end up in court anyway. Its a tough call. As regards your question about how much to offer? The creditor in question made the offer to me. I didn't propose an offer as I didn't want to appear to have the funds , somewhere...0

I have bad credit card debts & also a loan so a DMP may be something for me to consider... if I knew what it was!0 -
Cloudnine, can I ask why they are serving you with a statutory demand? Have you got a big debt with them, not kept up payments or what? Has this come about even though you are dealing (or not) with PP or CCS or whatever? Just wondering if I might find myself in a similar position. All my creditors have accepted offers throught PP apart from HSBC CC, Goldfish CC and MBNA. Have you had any dealings with any of them? All debts are in my name and the house is mortgaged to myself and OH. He won't be giving them anything apart from a *********** so they can think on!0
