Can the landlord make us homeless?

If you are in private rented accomodation, and then go bankrupt can the landlord/estate agents have us thrown out? :confused:

    They will have to give you notice to move, which I think is 2 months, but check your contract to see what your notice period is.

    Debt Doctor is good with this sort of thing, send him a PM and ask him to look at your thread.

    EDIT: Make sure you are up to date with the rent. Show the OR copy of the tenancy agreement and proof that you are up to date and appeal to his better nature not to tell the landlord. They have the discretion to do this and most will

    Hi Bluebelle,

    It depends on the landlord or agent. Lots of tennancy agreements have a bankruptcy clause in them, but the overwhelming experience on here is that they're seldom enforced.

    Not surprisingly, landlords are more interested in whether a tennant is paying the rent than their financial status.

    Is there anyway you can make some anonymous or discrete enquiries?

  • It's actually my partner who will be needing to be made BR, but he's the chief earner anyway. We have 3 kids aged 15 12 and 5 months.

  • As far as I am aware, if you have a BR clause in your contract that yes, in theory, you can be evicted. However, if you're on a AST then the landlord has to only give you 2 months notice to leave anyway. You can plead with the OR not to tell your LL (something I'll be doing myself, on my knees if needs be!) and if you're up to date with your rent and in no arrears then you might be able to convince him/her to not tell.
