Please help me get my money back from Britax!!!

Well 13 weeks into what should be an enjoyable chapter in my life, just quite plainly isn't...

I had my baby girl 14 weeks ago and since then I've contacted Britax about the pile of !!!! travel system I have... They have fobbed me off in saying that they are dealing with it and will get back to me shortly but that was first said 2 weeks before xmas :eek:

I basically sent them an email listing 10 complaints with the travel system and asked them for a replacement or a refund.. Heard nothing so phoned only to be told that its being dealt with and I then emailed again 2 weeks ago because I hadn't heard anything and had stood the night before in a deserted car park in the middle of a storm in tears along with my baby cos the car seat wouldn't release off the buggy... I had to wait for a complete stranger to come by so I could ask for help :o

And I've still not heard anything!!!

Can someone please tell me if I have any rights as to getting my money back and who I need to approach...

I stayed in the house for a week now cos I can't bare to go anywhere with it :cry:

    Take it back to the shop you bought it from and ask for a refund.

    Sorry I should of said that I phoned Toys-R-us first as that was where it was purchased from and they told me to phone Britax because of the extent of the problems... Was they fobbing me off?

    Also, I still have the receipt but it was purchased in August of last year, so do you think I'd still be able to get a refund if I took it back in?

    Appreciate your fast reply BTW ;)

    Sorry I'm a bit rubbish at this aren't I LOL


    Complaints are-

    The car seat often gets stuck on the buggy even though its supposed to be quick release.
    The rain cover doesn't fit over the travel system properly.
    The rain cover also takes up over half the shopping basket when its folded at its smallest.
    The head hugger in the car seat is not removable and therefore I can't put a coat on my baby cos I can't fit her in.
    As you lift the buggy up to go up a curb the front will drop down because the handle has too much "give"


    There are several more but these are a few that are really bothering me...

    I wouldn't mind so much but I brought it early on as everywhere had stopped selling them and I really wanted it!!! I even tried it out several times in toys r us but all my complaints are surrounding things that can't have been tested before because I didn't have the baby then...

    IMHO Toys R Us have fobbed you off. You bought the goods from them.

    I would take the buggy back to the store you bought it from and point out what I would class as the 2 major problems. The car seat not releasing correctly from the chassis and the handle problem when pushing it up a curb.

    As for the space the raincover takes up there's not much you can do ablout that. As for it not covering the TS properly which bits does it not cover?

    I don't understand the bit about the head hugger. Surely it should be removeable as babies grow so fast. Is it a 0 - 9 mth car seat?
  • Without seeing pictures of the travel system in detail it isn't posssible to comment on all of your complaints. The main problem appears to be the non quick release of the car seat from the buggy, the others mainly being design features which you don't particularly like. At this stage I'm afraid that you can't expect to easily get a refund as you've had the goods too long bearing in mind that your baby is now 14 weeks old and you appear to have only complained recently. If there is a "fault" the shop is responsible for it but if you are not happy with certain parts of the design then your only hope is that the manufacturers will look on your position favourably.

    Sale of Goods Act Quick Facts

    Subject: Sale of Goods Act, Faulty Goods.
    Relevant or Related Legislation: Sale of Goods Act 1979. Supply of Goods and Services Act 1982. Sale and Supply of Goods Act 1994. The Sale and Supply of Goods to Consumers Regulations 2002.

    • Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

    • Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.
    • It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.
    • If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)

    did you pay by Credit card?

    If so you could approach them and ask them to take the money back till someone decides to sort this out...

    Thanks for your comments...

    Its not the style of the travel system that I'm not happy with cos cosmetically its stunning hence why I brought it early cos places were getting rid of stock...

    So who's responsibility is it to replace it if its a one off faulty?

    And where do I go if no company is accepting or shall I say responding to me?

  • The shop is primarily responsible at this stage.

    The link below could perhaps be of assistance in getting things moving one way or another if neither the shop nor the supplier will respond to your queries. If you explain the situation to them they will offer you suitable advice .
