  • We have been wrangling with HM Revenue about what they say is an overpayment of £3000 for ages, they now want it all by early November or legal action will occur - please can anybody post some helpful advice to avoid this awful finale??????

    I'm paying back an overpayment that I sent in a dispute form about and challenged but lost. I'm still trying to get someone to look at my case, I even went to my local tax office, but no-one could give me answers and referred me back to TCO.

    In the meantime it went to 'Humber Recovery' which is the local Inland Revenue debt collection agency, I think. I'm paying back £220 a month on a £2600 overpayment by direct debit. I still hope one day someone will be able to tell me WHY I was overpaid when I kept them informed of changes every step of the way.
    DEBT FREE BY 60
    Starting Debt 21st August 2019 = £11,024
    Debt at May 2022 = £5268
    Debt Free Challenge - To be debt free by August 2024

    I hate the fact that they make you out to be a criminal when THEY make the mistake!!! icon13.gif:mad:
    Ha ha that'll teach me for being optimistic!!!

    The little darlings have now come back to me with a demand for £420 and haven't even acknowledged the fact I've paid the £90 odd icon8.gif And if I don't pay by a date in November they will take me to court :rolleyes::rolleyes::rolleyes::rolleyes::rolleyes:

    There's no way I'm ringing them any more, you get someone that fills you with optimism and hope, then they dash your hopes with another letter from them that contradicts what was said on the phone....................and you have no record or proof of what was said, letters for me from now on!!!!

    see how many have had problems due to the errors by TC software - NOT the fault of claimants - its a well known software error. Keeps defaulting to zero whenever anyone calls the call centre!
    I've finally bit the bullet and emailed someone from that site...............and almost immediately got a comprehensive, supportive reply back :T:T There's a mine of information and forms that you can use to fight your case, very helpful, so I'm going for it even though my amount is insignificant compared to many on this thread :o

    My partner had a phone call a few weeks ago from someone called The Lewis group claiming to be calling on behalf of the DWP asking her to repay over £1000 from 1998 & 1999. We asked them to send something in writing but had nothing yet. Until today, when they phoned again asking her to repay the money. And she was told to write to DWP if she wanted to contest the matter with proof. What proof? As a ’home maker’ for some years she does not have payslips going back this far. She told them that she wouldn’t repay any money, as it was over six years ago. And they say that because it is a government debt it can be reclaimed even after 25 years.!!!
    Is this right? And if so where does she stand?
    Any ideas anyone????:confused:

    P.S. how the hell can they justify waiting till 9 (NINE) years later to ask for the money back?
    Is our government in such financial difficulties that they need every penny they can get there hands on to keep this country afloat???????

    This sounds really weird to me that they haven't written to her first :confused:

    And I maybe wrong, but strange that the government are selling off their debt to a debt company - The Lewis Group, would have thought they would recover it themselves.

    I think I would keep pushing for written evidence, statements etc etc, from them :confused:

    Any idea about the length of time they have to reclaim the money? i thought the only exemption of reclaiming owed money (like bank charges) after six years was mortgege repayments ???
