    to be honest im much more relaxed about it then i was last week. will be good to say to my pal do what you like with the cash he has to pay it. until i found this board i had no idea about statute barred etc. so he had been waiting to get his self employed invoices paid and then pay it. he now has the cash to clear it but now can use it to pay taxes lol. in one hand and out the other but its a complete fresh start for him now. nand i wont let him get in that kind of mess again. thank you xxx

    Glad things are working out for you. If they come back with some bull !!!!!! story or whatever then let us know and we'll sort it for you, so long as you ensure you have no phone chats with them you'll be fine.

    Make sure your [STRIKE]boy[/STRIKE] friend takes you out for saving him the cash :beer:

    Hello,

    Very new round here (like registered 3 hours ago)

    Last week received a letter from MackenzieHall stating that I owed them some money, I told them I was pretty certain I paid it, so they told me to send them a letter from Westcot saying that account was paid. I haven't found this letter, so called MackenzieHall and explained this, the lady tells me to contact Westcot, which I do, they have no records other than they last wrote to me on 14/07/2004, So I called MackenzieHall again, explained this and said as far as I'm aware anything over 6 years can't be chased, she said, if it becomes statue barred, means they can't go through the courts but doesn't mean they can't write/call me etc etc, She said I could make a token payment of £150 and all would be clear, which is fine but I'd rather not pay it if it's just the sake of a few letters...

    Seeing as though Westcot can't tell me if or not I paid anything, they can't tell MackenzieHall.. therefore am I in the clear to dispatch a letter or two, telling them kindly to jog on.

    My only issue is, I've said over the phone, I will make the £150 payment on Friday, looking at replies on here it would seem this is irrelevant as I haven't written anything to them...

    What can I do?

    Hi

    You are right verbal acknowledgement is not acknowledgement in terms of whether its a SB debt or not..

    They are allowed to write/chase you for a statute barred debt until you send them a letter to say you know its SB and do not intend to pay. If you do this and they can prove its not SB then they'll soon let you know!

    If you paid westcot something in relation to their letter of July 2004 (but not all of the balance) then it would not be SB.

    Westcot don't know if I paid or not, all they know is they wrote to me on the 14/7/04, anything prior to that is gone..

    So If I send a letter to MackenzieHall stating that I believe it to be Statute barred and therefore I'm not going to pay and also explain that contacting me after it being statute barred could be deemed as harassment and all details would be passed to the OFT I should be fine?...

    All seems rather simple if I'm honest!?

    Nothing is ever that simple, as you'll find out!

    If you think you may have made a payment upto July 04 then you basically ignore everything until July 2010 and then send this - that ends it - totally!
