PS: not sending the SB letter until they confirm details and dates, which they haven't yet. Should I just do it? Or keep letting them waste their money on letters?0

Can you confirm if you paid after the 6 years had already passed? so you paid recently, but that was already later than 6 years so it was already SB'd when you paid?
If so you can try to get the money back as well. I already posted in that link back in November 09 mate - #8 - said the same thing then lol2010 - year of the troll

If so you can get the money back as well. It would be illegal for them to accept funds on a SB debt. I already posted in that link back in November 09 mate - #8 - said the same thing then lol
Yep, well after the 6 years. The debt would have been SB round about 2000-2001-ish. They contacted me in 2006. I foolishly started paying them, the debt was 1600, it is now 1100ish.
Not sure if I can get the cash back from them mate, it's unenforcable yes, but still a debt, or am I wrong?0 -

Ahh I edited post cos I remember fermi checking this and saying that it wasn't quite illegal - but you can stil lask, no harm.
Nope, there is no debt to declare, it is dead and buried. They have no right to demand money and the fact they pressured you into paying a SB debt is enough to get it refunded with some compo i'd say - remember the nasty threats they made at the time, what about the doorstep collector coming etc etc
You get the idea, that is how you get a refund and some compo for the "inconvenience" and harassment2010 - year of the troll

I wouldn't know where to start on that unless there is a template letter kicking about?
I really have no issue about paying my debts apart from this one. I was a young carefree student and I made a mistake. The issue I have with this debt is the way that the DCA went about it. The bloke on the phone was utter scum (dunno how he got my number, it's a company phone) That is why I will not pay this one.
Still, I'm happy enough with how my DMP is going, I've knocked this one off the list and the rest is manageable. It was 12.5K and I've just logged into my Payplan account to see it's now 4.9K. I'm quite pleased :-)
I'd love to wind up this DCA though...is there a template for claiming back monies paid for a SB debt by any chance?0 -

Not that I know of, if I get a chance over the next few day's i'll sort you one out!I'll post it here, however in the meantime click the link to the OFT complaints - register a formal complaint and mention you'd like refunded in the complaint, in order to walk away - otherwise you will pusue a claim for their harassment and breaches of legislation.
