  • I'm sorry to hear of your plight but glad to know your husband is now better.

    I don't know a lot about these things, but would it be possible to speak to a mortgage person at the bank and explain the situation and say you can now pay the mortgage plus some off the arrears? Maybe this will help?

    I'm sure others will be along who know more than me. Hope you get some good advice.

  • Please don't panic and stress (I know it's easy for me to say). Just follow all the good advice you've read on your other thread. No-one's going to turn up today and evict you. Agencies have a habit of sending out letters which threaten all sorts of things they can't legally do. Stay calm as you can. What you've been through to help your other half is awesome and you can get through this. I'll be checking in to see how today went.

    If no joy then you really need a solicitor now to plead your case. I think you are to far down the chain of events for us to help.

    Take the time now to go through the yellow pages to find a solicitor who will give you a free initial interview (most) and will offer legal aid (few). Please note I have no idea whether legal aid is available for this type of matter but just in case it is find a firm that offers it.

  • I know exactly how you feel, I'm pleased you DH is better sadly my DH is not going to get better We went through hell trying to keep a roof over our head, luckily Barclays worked with us and apart from £480 in charges (which we claimed back)they didn't persue the matter.Will they not redo your mortgage to cover the arrears so you pay eaxtra each month till it's cleared.

    As I don't know a great deal about mortgages I can't really give you any advise on that but I will say get yourself straight own to CAB and talk to someone. I'm sure they will be able to sort something for you. Good luck.

    If there is a possession order I assume it was suspended as long as you paid your mortgage and arrears, as you couldn't do this it sounds like they have now applied for an eviction warrant?
    I think you will need to apply to the court for the eviction warrant to be suspended, you wil need to tell the judge the reasons why you couldn't pay the previous order/agreement.
    Please seek proper legal advice on this.
