    You couldn't be in hospital with him and work full time at the same time.please hang in there we are going to help you xxx.
  • i was wondering if anyone can help or have any advice, i really hope someone can, we had a court order for repossession and we were allwoed to stay in the house, since then my partner took really ill and needed many operations, he is now back to full health but we have missed mortagae payments as i had to look after him, i wrote to the bank and they sent me a new direct debit form and then today i recieved an eviction letter, i am so scared now, we are at last back to normal my husband has his health again and is now fine and we have a steady income again from this month the bank never rang us to say this was happeneing or to see if we could pay the arrears etc, just an eviction order, are there any special things that can be done in circumstances like this as we are now better off per mth than we have ever been. i just dont know what to do please advise anyone, thanks

    I think you should call the Bank and speak to them. It's quite possible that the repo/eviction is being dealt with by one department - and your letter about making up the missed payments is being dealt with by another.

    Call the bank first and talk to them. It's vital that you keep talking to them, otherwise they will think you are ignoring their letters.

    If you can agree a repayment plan with them, it's highly unlikely that they'll go ahead with the repossession. But you must call them.

    Hi Pink sorry to here of your problems. I am off to work in a minute but didnt want to go without replying.

    Phone the court this morning and see if the mortgage company have applied for the warrant yet. If they havent, as other posters have said see if you can come to an agreement with them.

    If they have applied and the warrant has been issued, you can make an application to suspend the warrant of possession. This is done using form N244 (from the link below) and there is a £35.00 fee payable unless you are in receipt of benefits or a low imcome (see the second link for more info). You need to take these forms to the court and they will process them for you straight away and give you a date to attend court. It will then be the judges decision on whether the warrant will be suspended.

    While you are on to the court also ask them for details of the duty solicitors that will help you at court. The third link is for free legal advice - give them a ring they are really helpful.

    It sounds like the warrant hasnt yet been issued but even if it has try not to worry too much - there is still things you can do to stop it. Hope this makes sense I am typing in a bit of a rush. I will check back tonight to see how you are doing. x x

  • thanks the letter has no date on it just sayd that the bank have instructed a solicitor to apply an eviction order, and advises us to find other accomodation? but there is no date can they just knock on the door today?

    They cant just turn up at your door and evict you - once a warrant has been issued and an eviciton date set, the bailiff will hand deliver the notice with the date of your eviciton on - dont worry no one will be turning up today x x

    , i hope people dont see me as bad, i am sure some will, i know if i dont pay the arrears then we will be out on the street.
    the story goes like this, my partner took ill 2 years ago, (we have lived in the house 4 years this year) he had to start dialysis and wait for a transplant, i had to take so much time off work sick myself with stress and depression to help look after him, we struggled and missed some mortgage payments, the bank took us to court for a repossession order, taht we didnt even know about as we were in hospital, we were allowed to stay as long as we kept up the payments, then my partner was ill again(until he had his transplant we couldnt guarentee when he wouldint be ill)we missed some payments then we had the call, a kidney was found, the transplant was a sucess, but we missed some mortgage paynments all my fault but at the time my partner was so ill at times i didnt know what to do, he is now like any normal man! back to full healt and this month i returned to work full time so we can afford to pay the mortgage again, then today we had a letter to say the bank had applied to a solicitor to evict us, i am gutted, i havent told my partner any of this as he has been through enough, he said i was his rock for the past 5 years and now i am just going to let him down, the benefit system in this country didnt help when he was first ill his doc told him he has to stop work due to ill health and he went from earing £1000 to just over £200 and we coped the best we could, but without my money when i had to look after him, we have ended up in this mess, i am so scared and feel like i shouldnt be hear i have never felt so worried in all my life, i hope someone can advise or help, thank you x
