very unhappy with marshall ward

:mad: i recentley ordered a 4ft dvian bed with marshall ward 3 weeks ago.

i received a confirmation email from them with the price of £74.00

when i ordered this on line i could not beleive how cheap it was, this was the only reason why i bought it. they had even gave me my delivery date of the 2nd feb then 3 days ago i received an email from them saying that the order had been cancelled due to a pricing error on there part, and if i stillwanted the bed at the price of £185 i could re order it.

i feel this is disgusting the way i have been treated, as i had already arranged for my bed to disposed of when the bed was going to arrive.

can they do this, as it was not my fauly the price was wrong , i just thought it was in the sale. i did send them an email to say how disappointed i was , and they just replied with an email saying i should read the terms?

but why would i need to as i thought i was getting a bargain. can anyone help to how i can get around this and can they get away with it?

    Accept that they made an honest mistake in offering you the bed at this price and then realised it after you placed an order.
    They only offer the goods, they are not obliged to fulfil that offer unless they complete the contract and take your money for it.

    Personally, though, I would write to the MD and explain your disappointment and ask if he is prepared to help out, under the circumstances but be nice, polite and non-accusatory and you may get somewhere.

    If not put it behind you and move on.

    I understand how you feel, but many of us have been in this position when going for bargains we found on here or similar sites. No use fretting over it, move on and you will sometimes get the bargain, sometimes not.

    By the way....this really should be on the vent board and not grabbit.

  • This happened to me too. Was very disappointed as I placed my order on the 28/12/07 and they have only just cancelled. I also bought quilt covers and a quilt especially from them for the double bed
  • hang on a mo...have you paid up front for it or is it on account? if they have taken your money for it from your credit/debit card then I think they have an obligation judging by things i have read on here...not of course if it was on account.

    You should always read T&C's of every website before you do any buying or any sort of interaction

    You still should have read them! ! !
    their T&C's will read something along the line of: "any item that is mis priced, we reserve the right to cancel the order and re offer it at the correct price"
    as i had already arranged for my bed to disposed of when the bed was going to arrive.

    Well you have plenty of time to cancel then!

    I dont to be honnest, you ordered something that was mispriced, they contacted you to say it was wrong - you havent lost out on anything. They contacted you straightaway.

    Presumably you ordered the bed ONLY because the mis-price was posted on this site or HDUK.

    If you read their terms and conditions they are covered.

    It was a mis-price. They got lots of orders due to MSE/HDUK members. They cancelled them. They told you. Move on.

    I used a voucher (which I thought was open to everyone) to get £15 off an item recently. The voucher was accepted and the goods sent to me. I'd been using it for 3 weeks when they sent me an email saying I wasn't eligible for the voucher and they were charging me the money back.

    When I queried this they then took a further £10 credit out of my account which had been agreed by phone earlier because of another transaction.

    They seem to think they can just take money off you whenever they like. As far as I'm concerned, if they accept a voucher code and dispatch the goods, they have entered into a contract, no?

    The point is, because the goods were dispatched and this nonsense didn't arise till weeks later, I had no opportunity to return the goods. I had bought something at one price only to be told the price had doubled afterwards. How can that be right?

    I'm thinking of challenging them, by legal means if necessary.

    A lot of unhappy people! Some are apparently geting there beds. Heres my email to them

    Hi,

    Quote 'we have cancelled your order for the item in accordance with clause 3.2 of our website terms and conditions'.

    Part of clause 3.2 of your terms and conditions states 'If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details'.

    You have not contacted me prior to accepting my order. Indeed, you have accepted my order (as screen shots from my account on your website show) and taken the money from my bank account. You have also offered me the same item at a higher price which indicates you have the item in stock.

    As far as I can see, the contract is binding and legal and you should honour it.

    Please clarify what part of your terms or the law allow you to cancel this contract.

    If you insist on not fulfilling this contract and breaking the law then I have no option but to seek legal advice and possibly commerence legal proceedings.

    I look forward to your reply.

    Thank you for your email about the disappointment of the Divan bed.

    Here are our terms and conditions about ordering on line;


    2.1 All orders placed through our website will be subject to our
    acceptance of the order.

    2.2 When you submit an order to us on our website you will receive a
    'bounce back' confirmatory email of this order saying that we are
    processing your order. You will then receive a second email from us
    acknowledging your order and giving you estimated timescales for delivery. You
    should check both emails for accuracy and let us know immediately if
    there are any errors. Neither of these emails constitute acceptance of the
    order by us. Your order will be accepted by us (and a contract will
    then be formed between us) when we despatch the goods to you. Title to the
    goods will pass to you on delivery.

    Oh wind your neck in for Gods sake.
    They clearly have t&c's for such mistakes and disclaimers.

    Do not threaten legal action unless you know what your going on about
    Where do we stand? Anyone?

    Which you obviously dont.
