Actually it's very easy not to speed.

Actually, it isn't - not if you're a courier doing 90,000 miles a year on unfamiliar roads where limits often change quite randomly for no apparent reason. There's a dual carriageway near me that's gone from 50 to 40 to 30 in a couple of years and it is very easy to make a mistake. Also, I'm not sure how Lucifer's post is supposed to help the OP.
It's not supposed to help I'm just stating the fact that if you concentrate on what you're supposed to be doing & obey the speed signs you can get away with not speeding.

That's completely incorrect. As soon as it is posted (even 1st class) it is deemed as served.

They don't have to prove you received it. It is up to you to prove you didn't.

I know given RM's reliability that's not good but that is the way it is I'm afraid. It's also a stated case.

Having done a bit more research you seem quite correct, but I find that staggering considering the number of items that go missing in the post.

So much for the prosecution having to prove guilt. But as we know Speed cameras in most situations are all about money raising and not safety.
  • I dont actually believe the OP

He clearly got it, decided that he didnt want more points and listened to the amatuer lawyers and ignored it

Now he has got this hes trying to back out to the lesser charge

The fact is if it was that easy then everyone would just do it to avoid speeding charges and hope

I hope he gets hammered because he clearly is a !!!! and dangerous driver from his post
  • Actually it's very easy not to speed.

How many miles a year do you drive?

    Cretinous statement alert.

That's what the court will assume - but it's not that unrealistic! Things do get lost in the post - that's how I got let off with this offence.

But I was a pretty young lady who had a close friend working at the courts - most people wouldn't get away with this argument, even if it's true.

Interesting point - is there any other way to find out if there is a notice being served against you? If not, it's (even more) unfair to rely on Royal Mail 1st Class... if there is a website or something you can check on a regular basis, then I might get into the habit!

With a sanctimonious attitude like that you would make a good magistrate. Magistrates don't like truth to get in the way of a motoring conviction.

Magistrates too think theyarethesmartestman/womanalive too, so you would be in good company.

Actually..its very easy to make a "mistake" too...
Especially if you spend many hours driving....

You never did reply and tell us how many miles a year YOU drive..(in the middle lane at 50mph.)

Infact I think anyone posting in a speeding thread should state their yearly mileage, and speeding points.
Then we could see peoples points per mile average..

    I am 50000 miles a year. and 9 points.

Not disputing my guilt.. just pointing out that all you Angels out there may have just been "lucky" and not been caught YET..

I've got one of these, it's an MS90...

We tried to say we didn't know who was driving, to see if we could get off with the speeding ticket (36 in a 30 zone) - no, i'm not proud, and me and OH feel a little silly about it..

Basically, we pleaded the don't know who was driving, didn't attend court as the court was 100 miles away (where we were caught speeding)..

After about 6 months of court date coming and going and them writing and saying they were going court again! but we did not have to attend.. we wrote a letter stating that we have now found out through bank statements etc that it was my OH that was driving (which it was).. this was ignored..

A whole year after the offence, I got my license back with an MS90 £120 Fine and 3 points.

Like I say, we do feel stupid, but then again I am now bankrupt and don't have a car, OH has a car and bike and so we are probably saving on extra insurance costs.

They also backdated the 3 points to when the offence occured, and so we had already served 13 months of the offence by the time the court endorsed my license.

    Hope that helps...

& please don't have a go at me for trying to get out of the speeding ticket.. I think we got caught up in the hype of how you can get let off. The guy way hiding in a bush and we were doing 6mph too fast and didn't know the area, it was a wide road through an industrial estate and we presumed (wrongly) in was a 40mph zone..

  • I had 0 points too for 27 years... then I gat caught by cameras 3 times in 3 months... my driving style didnt change I was just on unfamiliar roads and "slightly" exeeding the limmit.

I know speeding is speeding and I dont dispute my guilt..
BUT everytime there is a speeding fine thread, there is a rash of posts telling the op he is a monster and a danger to everyone..

This is not ALWAYS the case, ( yes I do agree boy racers need dealing with)

I just dislike the attitude of posters who say "Dont speed dont get caught"
I defy anyone to say that they have NEVER exeeded a speed limmit EVER, and I beleive that sometimes you are just unlucky and get caught.

The op came on here asking for legal advice.
your opinions about his driving were neither requested or required.
