    we then have all the debt above on the house which he is insisting i pay half on which i can't do. he said he'd pay the mortgage if i move out into the flat but want's half on the house debts until he decides if he wants to sell or not.

    Decides if he wants to sell!!! oh honey poor you what an awful situation. of course he'll have to bloomin sell!! or give you half the equity in the property!! why on earth should you move back to your flat with the headache of paying for everything, be stressed out and short of money while he lives it up in a newly refurbished pad with your name on half of it!
    How much will the house be worth if you put it on the market once completed and how does that compare to the mortgage and debt balances that you have?
    have a greta big hug from me, be strong and get your little butt to CAB pronto. i think you need some legal advice regarding all of this esp with the mixed up debt, credit card consolidation in your name etc.

    Just wanted to send you (((((HUGS))))) I know breakups are devastating enough without being put under so much stress financially.

    I agree that you need to get advice from C.A.B. and he does need to sell that house.

    Keep your chin up.
    But these things take time, I know that I'm, the most inept that ever stepped.

    The house was brought for £195,00 he put a £10,000 deposit down. We have a joint debt of £31,000 on it and it was valued unfinshed at £230,000 there is noway i think it will sell in the market at the moment the house is in Rochester and is a character property - aghhhh i didn't even want to bloody buy it in the first place!!

    Sorry that sounds a bit harsh, I am on your side but you do need to get your life sorted, where he lives and his debts are his problem

    Obviosly we dont know the full story of reationship,but it seems to me that he was taking you for a ride:confused:
    You get a loan which he uses yet he expects you to pay for it.
    you get a house now he will decide what happens to it:mad:
    you jointly buy a house you really didnt want
    you use your cards to finance part of refurb now he doesnt want to know.
    It all sounds dodgy when you look at it objectively.
    How long were you together ?
    Does he have any debts?
    Do you think he was trying to palm them off on someone else?
    Sorry if these dont sound constructive, but just want to make you think about the situation in greater detail.

    OP is this a joint mortgage?

    it even paid off one of his credit cards but he doesn't care about that now.

    Providing you can prove it's not a gift but a loan and less than £5000, you can pursue it through the small claims court.

    I'd go to the CAB and get some advice as, if you were successful, there are many ways to recover the money including putting a charge on your joint house: though that could stop a sale and not advisable if you're still living there too.
