    Another :eek: story about names on cheques. I'm known by a shortened version of my second name instead of my first name (indecisive parents - don't ask!) All financial and legal things are in my first name but I have regularly paid in cheques made out to the name I go by i.e my shortened second name, plus surname. Not once in far too many years to remember has this been questioned.

    Perhaps I have an honest face ;):p

    No. The Cheques Act 1992 was enacted to prevent 3rd party cheques being paid into an account .. simply by the payee signing 'per pro' on the back. This applied, as you say, to crossed cheques. Where the cheque has to be paid into an account bearing the payee name ... but it stops far short of 'identical'. There just has to be reasonable certainty.

    Which 'certainty', as you see from this thread .... runs the gamut of 'A' to 'Z' .... and back again.;)

    I paid the cheque into Co-Op bank through the post office and it cleared, no problem. The amount was for 3.5K

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    Good result for you, but very worrying. What if there's another account holder with the same surname and a different title? In that case, you would be dependent on the issuer sorting this out and they are not likely to be motivated to do so!!! :mad:

  • I have recently received cheques in my maiden name -refunds from a property -council and electricity bills.
    My banking is in my married name although I am a widow.
    I am certain my bank will not accept these so my only option is to go to a 'money shop' to try to cash them with birth/marriage certs. It is a shame as they will take a large proportion and also photo copy docs.who knows where they will end up.
    These are only small amounts but I see no other way?

    Do you have ID in your maiden name? If so, open an instant access savings account in that name and pay the cheques into that. Then you can withdraw when they have cleared.

    You are worrying too much. You could equally ask: "what if there's another account holder with the same surname and the same title?" Banks must have hundreds of customers called John Smith. How could they know whether cheques made out to Mr J Smith are being paid into the correct account or not.

    The Cheques Act 1992 doesn't actually say anything about the names on the cheque; it merely makes cheques marked "a/c payee" non-transferrable:

    1 Amendment of Bills of Exchange Act 1882: non-transferable cheques

    After section 81 of the [1882 c. 61.] Bills of Exchange Act 1882 there shall be inserted the following section—

    “81A Non-transferable cheques

    (1) Where a cheque is crossed and bears across its face the words “account payee” or “a/c payee”, either with or without the word “only”, the cheque shall not be transferable, but shall only be valid as between the parties thereto.
  • I regularly pay cheques into an account made out to St Blah Blah's or Charitable Account, when the full name of the account is St Blah Blah's Charitable Account. No one has ever queried it.

    Why are you certain? Have you not asked?

    Take in your birth cert and marriage cert and talk to them, I can't see there would be a problem.
