Think about it from OR's view: they have accepted you have no interest in the property and its not an asset in bankruptcy. But now you want to contribute to mortgage? Why should they allow that? You are allowed to make reasonable contribution to all bills like gas electric council tax water tv licence, phone internet etc, but you cant pay a mortgage thats not in your name. Remember that whatever the surplus is, you will be left with a share of it to do what you wish. You can use that to make contribution to his mortgage iof you want.
A2C - I'm not arguing here but just trying to understand.
How is paying something for housing to a boyfriend (I'm assuming they are not married) different than paying housing to one's parents or even lodgings, paying friends for a room in house etc? OP was not working in paid employment which is why she didn't pay anything before.

It is a grey area. I expect otehr examiners may allow it. If i were the OP I would put something down for rent, but dont be surprised if OR asks for documentary evidence that this rent has actually been paid.
If OP was to move into rented property of course rent would be allowable. But as her OH did not get paid rent before, the examiner may take the view why should partner benfit from her change in circulstances by getting part of his mortgage paid, but the creditors not get any money back if IPA is not obtained. In cases where ther OR and bankrupt cannot agree on IPA, the court can decide.
In cases where a bankrupt has been living with parents and put down rent as an expense on section 7, I only allow it if they can provide documentary evidence that this was paid before BO. For example standing order or direct debit to parents on the bank account statements.
The thing to bear in mind is that it is part of OR's job to maximise the return to creditors, that includes seeking IPA's.0 -
Thanks for explaining that A2C.

Thanks for the further info...
really is appreciated..
I know i'm probably going to seem cheeky, but hopefully the OR will be kind to me.. fingers crossed..
At the end of the day it's better than paying £1400 out each month on CC & Loans, so whatever he decided will be better than that..:o

Hi! Although you are paying rent to your OH, why not buy (or download off web? Sure it'll be about somewhere) a tennancy agreement (the one that is for renting a room in a house occupied by owner).
Irrespective of it being your OH you will have documentary evidence to support your claim-rather than just 'I pay x rent' etc...about £7 from WH Smith but am sure some clever so & so may have a wweb-link (I could'nt find any!)0 -
Tenancy agreement - That's a good idea! :T
The thing is, times have changed for us, his business is not as profitable as it has been in previous years, his debt only increases if I don't help out, and so I really want to work together with him so that we can move forward with money and any leftover debts...
If I had to go and live somewhere on my own and rent then it would cost a fortune, so the OR must be able to see this..

Don't know if you realise but you included your dogs(and other animals)in you HK then have added £20 for dog food towards the end of your list. Not sure they will allow dog food on it's own either. Just a thought. I may be wrong as no other's seem to have picked up on it. Do you wear glasses you could put £10 for opticians.DalipFree impartial debt advice available from: National Debtline - Tel: 0808 808 4000 | The Consumer Credit Counselling Service (CCCS) - Tel: 0800 138 1111 | Find your local Citizens Advice Bureau
