My father passed away - his phone contract?

Hi Guys

My father recently passed away after a battle with the most horrible incurable disease.

He has mobile phone contract with Three, with 6 months left to run.

I have just rung Three to cancel the contract, they have terminated the services but have said that they will be taking payments until the end of the contract. I have to send them a copy of the death certificate.

Is this normal? The account is in my dad's name, but he was using my direct debit details.

    the debt is non-payable, just cancel the DD, fax them a copy of the certificate
    SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

    But AFAIK you can't cancel a DD at your Bank like you can a standing order, as the bank don't 'send' the money, the company 'takes' it (with your authority).

    You would need to cancel the DD with Three themselves, if you can.

    If it were me, I would phone them up again tomorrow and ask to speak to a Supervisor under the circumstances, maybe you just got a numpty on the phone at Three.

    So sorry to hear of your news bowser85, as if you don't have enough to cope with without companies providing less-than-sympathetic service like this!

    A DD is cancelled at your bank. It is courtesy to inform the drawer. They do not "take" the money, they ask for it and if the DD is cancelled they will be refused.

    If your father had a bank account in his name only then that will be frozen so they won't be able to take a DD from it.

    OP sais the DD was to their acount I think. With my bank (Halifax) I can cancel DDs online.
  • I think that is where the problem lies though as the direct debit is coming from the OP's account and not his fathers. I think you do have to go back to 3 and ask to speak to someone higher up regarding this contract.

    Whether they take the direct debit or not, surely it will still be a debt registered against the father's estate? Debts and contracts don't disappear simply because the person dies unless they have no assets. Whenever I've glanced through network t&c I think the full contract is still payable on the death of the contractee.
  • It does`nt matter which bank account the money comes from, Its the name the phone account is in,

    Once you send in the death certificate they will either ask if you want to take over the contract (some networks offer this) or cancel it all together,

    It`s such a hassle having to do this at such a time, I`v had to handle something similar myself, sorry for your loss
