Law Plus
Good evening,
Im posting this on behalf of a friend. Its regarding a letter from Kaw Plus demanding £420 and also potential court proceedings. He has no idea who or what it is they are after him for. Assuming its one of those car finance mis-selling things. Ive attached a few pages of his letter. They dont take phone calls or reply to any emails.
Thanks for any advice

Sounds like your friend has been burying their head in the sand.
First thing to do is find out what it is for.
Second thing is to decide whether it is genuine or not.
Then the decision on what to do next which could be a) pay them, b) complain to them about being missold. c) reinstate the contract and allow it to play out (uncancel it).

It reads as if he has engaged them and then cancelled before the matter reached a conclusion, and they are invoicing him for work done so far. We used to see a lot of this from ppi reclaim firms.
He can ignore the blue document as this is just a 'if we started s court claim, this is what it would look like' thing
Seems a common story

I'd suggest requesting a copy of the agreement signed. Likely to be an online thing that he might have clicked on without realising what it was which may make things difficult.

Thanks for all the replies.
HHes Asked for proof of the agreement. They dont accept phone calls, so hes sent an email.
Looking at the TrustPilot reviews, they're pretty handy at this

Yes I think all but one of the reviews were critical 1-star reviews.
When I looked at the one 5-star review it was a hacked-off punter who had ticked the wrong box!

As advanced warning, they do not need a wet signature to form a contract, whatever contract they send, if signed up on social media (often "hidden" as a free check), it can still be valid
Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

I agree that wet signing is a popular myth. But what is needed is a clear indication that both parties intended to form a valid contract. That is where "hidden as a free check" comes unstuck in court.

Is there a way they can prove you've agreed with an online form? Surely anybody can sign something online pretending to be somebody else. Especially with so many data breaches.

usually yes. Plus, typically, they include follow up emails confirming the terms of the agreement.

But then, how do they get the correct address and email address?
