    hi thankyou so much,

I have studied that thread and the said post.

So just to confirm before I proceed, I should complain seperately to the landowner (thankyou for the google info. I will look them up and find the patronage documenta you say? What should I say to them to complain about the company Regus?

and secondly to appeal using Edna basher’s Template I should just appeal on the UKPC appeal link? And to confirm it’s the correct template:

    Dear Sir,

    Parking Charge Notice [0123456789]: Vehicle

    Registration [AA11ABC]

I refer to the above-detailed Parking Charge

Notice ("PCN") issued to me by Highview Parking Ltd ("Highview") as a Notice to Hirer. I confirm that as the hirer of this vehicle, 1 am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 ("POFA") and I write to formally challenge the validity of this PCN.

You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge.

There are a number of reasons why Highview's Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.

Given that Highview has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

Thank you for your cooperation and I look forward to receiving your response within the relevant….

Also, Should I replace Highview in the template to UKPC or Regus?

On the UKPC appeals page the only options in drop down menu for appealing as are: driver, Registered Keeper or Registered Keeper and driver.

I am assuming I should select Registered keeper and carry on with the template explaining I am the Hirer?

    thankyou for your continued help

  • Hi, thankyou for your guidance.
I have submitted appeals for both charges, still have 2 days left for the 14 day appeal period. hope this works and it gets overturned.
    will keep you updated.

Haven’t complained to the land owners as confused how to go about that without accepting responsibility as a driver.

"still have 2 days left for the 14 day appeal period."

    There is no such deadline.

You have 28 days to appeal and will not be paying a penny, regardless of outcome, so the arbitrary 14 day discount bribe timeline is irrelevant to you.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Obviously you would change the name of the parking company to the one involved, in your case, UKPC

As for any complaint, the Royal We is sufficient, which fails to identify the driver, because you are complaining about it as the hirer

  • Hi,

I have appealed and also made a complaint last week on Friday but haven’t heard anything back yet. Should I wait or send a followup complaint?
how long would it be for any appeal answer to come back. Do you happen to have any idea with this sort of issue?

A private parking company has 35 days to respond to an appeal

I would expect that a complaint to a company should receive a reply within 2 to 4 weeks, if they bother to reply

  • Hi,

I have just received an email from UKPC asking for information about the driver,

“Thank you for your recent correspondence in relation to parking charge reference …

To assist us in making a decision regarding your appeal, please confirm the full name and address of the driver to our Appeals Department within seven

days of the date of this letter.

Schedule 4 of the Protection of Freedoms Act 2012 discusses the recovery of unpaid parking charges. It allows parking operators to hold the registered

keeper liable to pay unpaid parking charges if the operator has not been provided the name and a serviceable address of the driver.

This information may be confirmed by submitting another appeal on our website at www.ukpcappeals.co.uk, or by post to the address overleaf. Please

ensure that if writing to us by post that you include the parking charge reference number and vehicle registration.

Failure to provide this information will give us no alternative other than to make our final decision based on the previous information received. At this stage

a POPLA verification code will be provided.

The parking charge has been placed on hold whilst under appeal and may be settled in full at the current PCN rate of £60.00”

I am unsure of what to do about this now

You do not respond, they are fishing for the driver's details so they can get round the fact that their PCN is not POFA compliant.

  • thankyou, that’s what I thought too. They will very well send a POPLA code too by day 35?
I would need to be prepared what to do in that scenario or should I just cross the bridge when I come to it
