Hate to be a downer, but it probably doesn't matter. IAS is a kangaroo court and reject 90%+ of appeals regardless of how valid they are.

    Who is the parking company?

    Who is the land owner?

  • no idea of the landowner its a privately owned public road

the company are vehicle control services

all these appeals seem to be a bit of a kangaroo court but if i dont go through the motions it wont look good if it goes to court.

they have said the driver is responsible for this and i have legally accepted documents to prove i was not driving and i will not name who might have been driving.

Was the road in an Airport? If you were not driving and can supply your driving licence as an exhibit, to compare with the photos VCS have, AND clearly show that the PCN was non-POFA, you'll win.

But doing an IAS appeal online is fairly easy. What is going wrong?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • its the approach road to an airport . i have evidence that is accepted in courts on a daily basis of where i was at the time this happened. i would rather not let this type of people see my license they have asked for my insurance but i dont have insurance for this car (it is insured) i also have work reccords to show that i was miles away from where it happend.

  • the problem with the appeal is that i am not good with computers and i cant get past entering the details of the invoice i was sent. they are sending me forms.

Then do an IAS appeal with proof of where you were (and the insurance document with first names and postal addresses of insured drivers partially covered up but showing enough letters to show it's not your name) and include a signed & dated statement (by you) that you were not driving. Thus, Elliott v Loake - which is irrelevant anyway in private parking cases - cannot be relied upon jn this case because there is evidence it was not you.

But honestly I WOULD NEVER DO THIS BY POST AND CERTAINLY NOT SENDING IT SIGNED-FOR!

Surely someone can bung it in for you some time this month?

  • sorry for the delay but have been away working

i have done the appeal by post including all the evidence that i could not have been in the car at the time. these are legal documents that are used in courts on a daily basis. also i sent work documents showing where i was at the time. i cant send them insurance as i dont have insurance for this car it is insured to comply with the law but not by me. vcs have clearly said that the driver is responsible for this charge. if they still want to try and get me to pay it will be with a court order.

The IAS has very bad history. set up by Davies and Hurley of Gladsones solicitors. The twins split when they were exposed by the Parking Prankster a few years ago. They continue to operate a sham to protect their members

Take Smart Parking, they went from the BPA to the IPC, it's clear seee why ???

And do not forget that the BPA ere so stupid to take on a new appeals service run by a a solitictor being Wright Hassal solicitors which we called WHOPLA.

How stupid were the BPA to even thinlk WOPLA would offer a fair appeals serice … they did not and then Wright Hassal would sue people. Wright Hassal survives in QDR who pop up every now and again aand be played with, just like DCBL who you can see on here

    The OPC/IAS

  • i dont believe there is any fair appeals service its all part of the scam to extract money from drivers. the whole industry is one big scam backed by the government who get part of every pound extracted.
