Help on rejecting a new car!

I am leasing a car, within 7 days of getting the car, the car struggled to stop when i need to let someone go past me, i immediately rang the RAC who came and did a diagnostics test which returned faults including breaking faults, deemed it undriveable.

2 weeks later the car got taken to the supplying garage (who initially said they wouldnt challenge the rejection) who cant get the faults (when rac plug machine in it wipes the faults). they have taken it for a test drive and it hasnt happened and deem it safe.

i am trying to reject the car as i no longer feel safe putting my kids in this car, however the finance company are saying the RAC report which is my evidence along with my statement of what happened isnt not sufficient to reject the car, they are offering a second garage (same brand as supplying garage) to run checks - i still dont feel ok driving this car.

The garage are rejecting my rejection (becuase they say its safe) and the finance company are also rejecting my rejection and i dont know where to turn as i need a car and cant afford to have two finances running! can anyone help!

everywhere i read it says im within my rights as per the consumer right 2015 to reject the car but becuase they dont deem it faulty they say that doesnt apply!

    If you are leasing the car then the leasing company are the owner of the car.

    what does your lease agreement say about rejecting the car or terminating the lease?

    What are the dates when you took posession of the car, and when you formally notified the dealer you were rejecting it?

  • i received the car on the 17th august and this incident happened on the 23rd and i notified the finance company that i wanted to reject on the 26th august.

    the finance company are the ones rejecting my rejection as i believe its up to them to reject it and fight it out with the garage - the lease says its not cancellable but says the consumer rights 2015 are not effected but nothing about rejection.

    I'm struggling to understand how brakes do not work in one situation but then be fine at all other times. Is it an EV? I'm not fully up to speed on EVs yet, but could this be some sort of software or electrical fault with regenerative braking that meant that it wasn't working that one time?

    If you need a car and won't entertain using this one, you might consider buying a very cheap runabout to tide you over while you argue this one out. As sheramber says, there probably isn't a quick route to resolving this.

  • yea so the fault that came up was an error with the communication to the brakes - it had worked for 150 miles that week and then i drove 200 miles to go on holiday and i was slowing down and it was pulling away (almost like it was in too higher gear and pulling away but my foot was on the brake), something then make like a click noise and it revved down and stopped. but hasnt done it again in the time they have test driven but how can i trust when i approach a crossing with a kid on it that it will stop!

    What make/ model is it?

    You said you were stopping to let somebody pass you.

    Does the car any anti collision software that could have interpreted the vehicle behind as too close? Don’t know if such a thing exists.

    Have you taken it to the second garage that the finance company offered?

  • this is happening but they cant do that until the 22nd october - im now with out a car for a month and having to cancel all my little girls clubs as i cant get her there. there was nothing behind me it was car on the other side of the road.

    If you are adamant you won't use the car, then buying a very cheap runaround or using taxis is the way forward. This isn't going to be solved quickly because I can understand why the dealer and the finance company aren't simply going to give you a refund or a new car on the basis of one incident that didn't lead to an accident and which appears not to be replicable.

    The above account sounds almost like 'sudden, unintended acceleration' — the phenomenon beloved of American lawyers and occasionally reproduced in the real world.

    OP, on the assumption that the car is an automatic, were you braking with your left or right foot during the incident? Secondly, did you have cruise control or any other sort of speed regulator engaged at the time?
